Wells Fargo Auto reposessed my car. I attempted to contact the company to make arrangements to pay them. The woman, Summer, asked me if I had an income and I told her no. I own a part of a business and did protect the name of the company as I was not sure if I should reveal that so early in the conversation to protect the other owner. Since I have never been in a position like this I do not know the proper way to approach it. She did not identify herself as the case manager so I had no idea if she was just a customer represenatative or what her position was. My initial inquiry was to get the information needed to rectify the situation and redeem the card.


I am not paying myself in the company and have not been generating an income. This is the reason I got behind in my payments. Summer told me without proof of income I could not get the car back. I spoke with my business partner who said we could give her financials and to call to redeem the car. I then called Summer back and told her that I could provide her the financials and how could I proceed to pay them and get the car return. She then told me that I was a liar and she began to berate me. I asked her what she would need from me to prove my financials as I do not get a paycheck. SHe remained insulting continuing to make  personal judgements about me and verbalizing them. I asked for the name and number of her manager and she would not give me the information. I admit that I got angry as I simply wanted to provide the information needed to rectify the situation. 


Finally the manager Jessica got on the phone and told me if I didn't calm down they would not give me the car at all. I told her fine and the manager Jessica chided me like a child telling me she had the power to refuse the car to me all together. I said to her, "you do not have to speak to me like a child," and she then said to me, "take the weekend to decide if you want to pay the full amount of the car" and told the associate to hang up on me. I will admit that I was angry at the way the associate, Summer, treated me and lost my cool. Both of these  associates were more concerned with their personal opinion of me and would not answer me directly to what needed to happen to redeem the car. I have fallen on hard times, but called to sincerely rectify the situation. I would assume that this company would like the money that is owed on this vehicle. I would like to take this matter to the superior of Jessica and negotiate what is needed to rectify the situation and get the car returned. The balance on the car is also incorrect. I have been trying for a year to get them to adjust it and the have failed to do so. I can provide the information they require and am working to get all of the past due together to pay them. I do not need a moral judgement from an associate who does not know me. I just need the information of what is needed to redeem the car and then continue payments.

Because it sounds like the only RipOff may be the way you are running your company.

If you are not paying yourself, what good are the financials of the "company" going to do.  Is it the companies car or your car?  I am sure the IRS would love to know about this arrangement where you don't pay yourself but are able to redeem a reposessed car based on COMPANY financials.  If you wanted to prove YOUR finanical worthyness you would supply them with YOUR tax returns proving income, how ever you get it.

But lets say you do redeem the car,  how in the world are you going to continue to pay on the loan with no income?  Again, this sounds like you and your partner may be doing something I am sure the IRS would be interested in. 

I am NOT defending their attitude, and it does appear there was some "attitude" on both side.  But you borrowed several thousand dollars for a car.  Part of that agreement was that you would pay back a set amount of money each and every month.  It was not only IF you can, or only if you don't have other problems.  It was EVERY month.  Once you became behind they reposessed the car.  They are under NO obligation to let you redeem your car and continue payments, especially if they feel that you won't be able to.  This is why they appear to be requiring you to pay off the loan in full in order to get the car back.

As for the balance you think is incorrect.  You need to make sure you are including the additional interest, late fees, repo and storage fees into the balance you think you owe.

My car has a repo order on it.  The company who has the vehicle is the who you need to speak with in order to receive the vehicle back.  I know this because I was told by an atty that if they did repo the car, then I would have to pay the repo company directly for the vehicle as well as any fees the company would assess.  He said what typically occurs is the repo company will purchase the dept and that inturn makes you indebted to them. 

some repo companies will charge $5K for the repo and most of the so called repo companies Wells Fargo Auto uses are owned and operated by them. 

Insofar as the nasty reps, I have someone assisting me and they have POA to speak to and deal with WF.  WF is not to call me at all.  My POA received a call from WF and they stated "I can and will ruin her credit if she doesn't pay", "Do you want us to ruin her for life?"  My rep knows not just the law but also what reps can and cannot say.  That is one big thing they cannot say.  They are bullies.

My POA received a call from the repo company and the rep stated "she is skipping out on a debt'.  They cannot say this.  it is illegal per the Fair Debt and Fair Credit Reporting Acts.  He advised them of the fines per occurance. 

We have yet to hear from again and this was 4 months ago.   All I can say is to contact the repo company and if you need to, file a complaint with the Federal Trade Commission..  I really dn't know what good it does though.  WF ignores requests for info from the FTC as well as the Comptroller of the Currency.  Apparently WF and its associates are above the law!
