In June of 2007, I purchased a WI Dells timeshare after getting one of those "mini weekend vacation offers" "Sucker #1"... all was well and I did get to use it once (April of 2008!!).

In May 2008, I bought into (again being stupid) one of the Party weekends.

It was in NYC, and after shelling out $1998.00 for a weekend at a ritzy hotel..the rooms sucked though. My sister and I and a friend did see a great show and had some fine food (all bought with the $1998!)

Then comes the Sun am "presentation. Well stupid me again I went for the buying more points story... I was in a rush because I had a plane to catch, and I signed.. gave them $450 deposit and they agreed (as they always do to make it affordable to spread out the deposit. $520/month for 4 months, $82 in maintenance fees for 210,000 points annual. I made the June payment and maintenance fee THEN on July 7, (2 months after this supposed deal) I get a phone call from the title service area at Wyndham saying that the mortgage wasn't recordable since the notary witness didn't print thier name, it was illegible and so they were sending out another mortgage contract to sign. HOLD ON!! The next day I call and get a girl on the phone and I explain about the message I've been left. After 10 mins of holding, she gets back on and says, no the mortgage is fine, it was a mistake and I got on a call list by accident. THEN I get the letter in the mail. Now I call back a few hours later (from work) and get the same girl, who puts me on hold for another 10 mins and this time tells me yes indeed, the mortgage wasn't recordable and she repeats as is stated in the letter, that they would like me to take it to a notary, have it signed "legally" and then return it and I'll get a check for ...a big $50 "for my inconvenience'. I told her I wasn't re-signing ANYTHING, and that I'll talk to my attorney. I have written a letter to the Atty Generals of NYC (where the transactions took place) along with the supposed Escrow company at Holland and Knight LLP, Atty Gen's of Fla,WI (where I live) and SC the state the property is in (N.Myrtle Beach, SC-Ocean Blvd Towers)

Does anyone have title/mortgage experience, since this mortgage paper isn't legal and recordable, is the 'promissory note legit" and can they hold me to it?? They re-dated the new mortgage July 1, but everything else is May 4. I think the whole deal is invalid...Help!!

I read your story. First of all while I see you are upset, I am not sure what the big deal is. Yes all the documents should have been notarized with the correct date to begin with. The note and mortgage are two different documents that have different meanings. The note is your promise to pay back any monies you borrowed. The mortgage instrument, is the lenders security to collect on that promise. Thats why you give them a mortgage, not them giving you a mortgage. That said, as long as all the terms of the note are the same ( Payments, interest rate, amortization schedule) and the the terms of the mortgage are the same, and you are happy with the lay outs of the units, properties, and with what you paid for all the points you bought, I do not see what the major problem is. If they want you to sign a corrected document its no big deal. You probably agreed to do just that at your initial closing, on one of the forms you signed. It does sound like the someone gave you a bit of a run around when you called, but someone was probably giving her wrong information and she just repeated it. Not everyone you speak to is a genius. So bottom line, if you are basically happy with it, and the money part has not changed you should enjoy it. I do not belong to Wyndham, but do have a Disney timeshare and my family loves it.

For your information, I DID my part on my issue, it's the Wyndham people who did not "follow directions" and yes, I should have caught the notary issue. I'm glad you're satisfied with your deal. Let's see how you feel when you take your first trip, and they have Owner relations person come and "schedule" time, then they want you to come "talk" to them...(another 90 mins plus) you'll see... Otherwise, I hope you have fabulous time and enjoy your vacations!!! Good Luck.....you'll need it!

I have read several reports here because I have recently become an owner of points from Wyndham. One constant that seems to be true, is that some of you claiming a ripoff actually are responsible for not following the instructions. Also, I was told by the sales person that while I would not get my first choice 100% of the time, I should plan well in advance if I am going to a popular resort during Prime or high season. That makes sense to me, and I have already booked my first trip without any problem. I also find it very hard to believe that a company with Wyndham's reputation would have allowed a unit to be as bad as one report indicated. However, if that was the case, they certainly would not have docked her/him the points when they complained. I believe some of these reports are made because people cannot read, listen or follow directions.
