I purchased my timeshare on June 2nd and I have a phone bill that shows i've made phone calls to Wyndham Vacation Resorts that whole first week i signed up. I tried to cancel on June 7th, which is within my 7days of cancellation and left a message to call me back. I did not receive any phone calls till after my cancellation period ended. I was told by the sales rep., Jerry Cartwright that I could cancel anytime and "not to say anything but you have 7-days to cancel with a full refund". Yes, i quoted that b/c those were the exact words he told me. And yes, he did say i could cancel anytime. I spent 4-hours on my vacation and i asked him numerous times, with my girlfriend next to me, whether i can cancel at the end of the month, a year from now, or years from now if i dont want it. I was told YES every single time. Anyone would sign up if they were given that opportunity. I was told to call him if i wanted to cancel, which i did. I never received a phone call back and waited. I called back again and got a Sales Manager, Paulette Lake, and she said i should look into renting it or having my sister co-owner with me. I said no i want to cancel and she told me Jerry would call me back. Keep in mind, I was never told to write a letter, I was only told to call them if I wanted to cancel. I didn't receive a call back for a few days so i called again and finally talked to Jerry. He said I couldn't cancel and I should look into renting it out. I said no i dont want to I don't want this anymore. So i eventually talked to Paulette Lake again and she said I cannot cancel and that i'm pretty much screwed. Now this was at the end of the month of June. They gave me the run around never returned any of my calls. After numerous voice messages and never returned phone calls, i got a hold of Director of Marketing, Keith Smith, who has actually been helping me cancel this whole thing. He told me to speak to Directory of Sales, Darren Koch, but he was no help and told me to talk to some Director of Membership Sales, JW (his first name). I never received a call from that director so I called back Keith Smith on July 5th. He told me that I have 90-days to write a recission letter and to send in the phone logs and highlight the phone numbers for Wyndham. Now today, July 7th, I sent a Certified Mailed letter to cancel. I will fax out a copy of the letter tomorrow. BTW i did not notarize these letters. I wasn't sure if i had to. i guess I'll get them notarized and send them again.

I was hoping to find a lawyer that would help me with this. I am a New York City Firefighter and will probably call a FDNY Union lawyer but was hoping if i could get someone with experience with this matter to help. Also, if i can get any tips on whatelse to do. I tried to cancel within my cancellation period but never received a call back. After reading this site, it sucks to say, but i'm glad i'm not the only person going through this. I will gladly take these people to court and tell any news outlets willing to listen. I feel bad b/c my girlfriends parents on a timeshare from this company and they were told that they could cancel anytime as well and they've been members for a long time. I dont understand why this company isn't shut down for criminal actions. SOMEONE PLEASE GIVE ME SOME FEEDBACK ON WHAT TO DO!!!!

I've tried also to get my problem with Wyndham resolved. I feel that a class action law suit againt Wyndham may be the way to go. How many of us are going to be put into the same situation that we are in. Wyndham needs to be held accountable for all of there actions, along with there sales reps/manager, etc. My troubles are with Wydham @ Skyline Towers in Atlantic City. If anyone out there can refer me to a good attorney who practices law in NJ I would be appreciated. Thanks and good luck to all.

I have been and continue to be a happy owner of three different vacation ownerships, one of them is Fairfield-Wyndham. First I would like to say in response to Joe from TX, what are you talking about? I've been an many a "timeshare tour" in the past 10 years and not one time have they ever offered me anything to drink other then coffee, tea or soda. I don't know where you have been taking you tours in the past but I do think you're just a flamer trying to get published. Back to Victor. I hope through the lesson you have come to understand that you must read what you sign, and understand it. I pulled out my copy of my Wyndham contract and I found in 3 differnet places how to cancel the contract. It states the time frame( 10 days) and where to mail the cancel letter to(it's not the sales office in Stroudsburg-by the way). It even give the customer a phone number to call is they wanted to cancel by phone-still not the sales office in Stroudsburg. As for the sales team in Stroudsburg, I have been going there for almost 20 years. I have meet with Paulette Lake and Keith Smith many times. They have been nothing but helpful to me and my entire family. It just sounds to me like you were trying to get out of a contract after the fact and you just wanted a way out. The assignment agreement you mention is in fact not about the new owner, but about the company which you bought the Timesahre from. They have the right to cancel the agreement at any time if they feel it nessary to do so to protect the intrest of the company's name. I know I will get some fallout from this response to Victor's "plee" for help, but people use some common sense and read what you sign and stop playing the victim of "foul play"

Calling customer service support boils my blood cause they are just pushing me around, asking me to hold while the transfer my calls and telling me that there is nothing they can do. I've sent a cancellation letter to their department but have yet to hear anything from them. I'm from Arizona and I bought the property in San Francisco, CA. I've also heard that I'm not supposed to be able to purchase that product because I'm marketed from Arizona. Does anyone know if this is true? It'll be great Victor, if you could pass me the contact of the higher management in Wyndham so that i can get my compaints heard. I'm just being bumped about right now by all these events. Any help will be greatly appreciated. Thanks.

After almost 2 months of lack of sleep from worrying about this whole mess, I was finally able to get it cancelled. I left a voice mail for the Director of Marketing, twice, yesterday and today. I contacted a lawyer and he read through the contracts and stuff like that. He then started writing letters to the Las Vegas Office, Orlando Office, and Shawnee Office where I purchased. When I got home, I received a phone call from the Director of Marketing. I asked him what was going on on his side and he informed me that the letter I wrote was circulating around their site and that the Sales Manager will have to comment on why these events happened. I let him know that I spoke to a lawyer and that legal notices were being sent out to all three sites. He then gave me the name of an Administrative Manager in Shawnee that will contact the person that make the decisions on who gets to cancel and are located in South Carolina. After we hung up, I contacted my lawyer and gave him the name of the Administrative Manager and asked him to send the legal notice to her as well. A few minutes later, I get a call again from the Director of Marketing telling me that after everything I went through the person in South Carolina emailed him to cancel my contract immediately. This is where I stand at the moment. My lawyer is on stand-by with the legal notices. I asked for written word that my contract will be cancelled and am hoping for a refund. I am not out of the woods yet. This will not be over until I get that check and the written word stating it has been cancelled. Advice to those who are trying to cancel. WRITE DOWN EVERYTHING. KEEP RECORDS OF EVERYTHING YOU DO FROM PHONE CALLS TO LETTERS. GO ABOVE EVERYONE YOU TALK TO AT THE SITE AND KEEP PURSUING (you will not get a straight answer from Managers or Sales Reps, they are all small fries, speak to one of the big fish and explain your situation to the letter). CONTACT A LAWYER IMMEDIATELY, THEY WILL REVIEW THE CONTRACT AND IF POSSIBLE HAVE THEM WRITE A LETTER STATING THAT LEGAL ACTION IS BEING PURSUED UNTIL YOU GET WHAT YOU WANT. AND JUST KEEP ON PUSHING UNTIL THE VERY END. It's going to be a very long and frustrating journey but it can be done. These people want to save face and not have any negative attention around them. Like my lawyer said, "They are thieves without handguns." Eventually someone is going to get word out to the media and really expose these people for what they really are. Good Luck and I'll report back as soon as I get that letter.

I did send a letter at the beginning of the month with a copy of the cell phone record showing i did call. I sent it by Certified Mail and made sure it was delivered. Also, I sent it by fax and received a confirmation that it was sent. I will call the Director of Marketing tomorrow hoping that this will get resolved soon. I contacted the media hoping that they would hear my story and help everyone here. So far everything has been a waiting game. If things don't go my way I will most likely sue hoping that Fraudulent Misrepresentation is the case. There is a part in the Assignment Agreement that states: "11. This Assignment Agreement and all rights granted hereunder may be terminated by Owner, or by Owner's successors or assigns, at any time; however, any such termination shall be subject to any outstanding reservations against the Property. Election to terminate will be noted but all reservations existing as of the termination date will be honored. No new reservations will be accepted on or after the termination date. If this Assignment is terminated, future access to the Program will require approval of the Plan Manager and include a conversion fee. If not terminated sooner, termination will occur on the earlier of the following dates: a) termination of the Declaration in which the Property is located in accordance with the underlying Declaration of Covenants and Restrictions establishing said regime; or b) termination of the plan; or c) termination by Trustee after Trustee has determined that the Property has been rendered unsuitable for continued use in the Plan; or Upon termination, Owner's Points will be extinguished and Owner will no longer have the right to make reservations in Properties dedicated to the Plan and said use and occupancy rights in the Property shall automaticall revert to the Owner. 12. Upon termination of this Assignment agbreement or in the event Owner defaults on his obligation under the Contract resulting in the termination of said Contract, this Assignment Agreement shall be deemed terminated and cancelled and all rights of the Owner hereunder shall cease. Upon such termination Plan Manager shall cause the use, occupancy and possessory rights in the Property to be returned to Owner, subject to any Owner commitments or confirmed reservations in the Property by another Plan participant which may have been made pursuant to the Plan. Any fees due the trust by Owner shall be deducted from the assessments made by Owner at date of termination. Upon such termination, all such benefits and obligations of Owner pursuant to the Contract shall continue in force and effect." I'm no lawyer but i believe that says I have the right the cancel any time. If I'm wrong please someone tell me. This whole thing is a mess and confusing as hell.

After a week of no response from Las Vegas, I called the Keith Smith, Director of Marketing in Shawnee, PA. He's been helping me try to cancel this whole ordeal. I told him I did not receive a response and he said he'd look in to it and call me back. He called me back a few minutes later and told me I was denied and that they tried to contact me by my house phone number which was incorrect. He told me to email him the letter I wrote and he'd find someone to help me cancel. What I find strange is that I never put my house number on the letter I wrote. Also, I specifically wrote that I should be contacted by email or my cell phone. My house address, email, and cell phone were on the top of the letter. It makes me wonder if they actually read my letter. Of course I'm back in limbo and waiting for Keith to contact me next week about what happened. Unfortunately, I don't make enough to hire a lawyer but I did contact my local media today and mentioned this website. So I'm hoping we all can get some help.

Thanks for the comment. I've been talking to the Director of Marketing up in PA and he's been helping me with this whole thing. He told me that I should receive a response from Nevada within the week and to call him back next week. He mentioned that I should be prepared for the worst b/c the people in Nevada are paid to say "No" and that he'll help me contact Florida which is where the place is actually run. Nevada is only the Finance Department. The actual headquarters is in Orlando from what I was told. He said that the Orlando people would definately be able to help me b/c they don't want to risk damaging their company name.

I signed in NYC in May, 2008, I'm a single mom, and now found out that the mortgage was "unrecordable"..hoping this might be a way out.. I'm writing to the "supposed" Escrow agent in NY and the Atty General of NY,FLA, WI (where I live) and SC (where I bought). [email protected]... we need to get these guys from scamming any more people.
