In February 2016, Dr. Jenny Jin made an unauthorized change to my medical record, replacing a prior diagnosis. This alteration introduced significant errors into my medical record, which have since had serious implications for my claim for service connection. Please refer to the attached image of case law demonstrating that a diagnosis is a “key element” in such claims.

On March 31, 2016, Judge Banfield reviewed my claim for service connection, relying on the altered record created by Dr. Jenny Jin to request a medical evaluation. During this evaluation on August 20, 2016, the medical examiner, Michael Frazee also relied on Dr. Jenny Jin’s erroneous amendment, ultimately resulting in the denial of my claim for service connection.

Now, eight years later and after two reviews, I am preparing to request a third review. I aim to clarify to the relevant authorities that their decision rests on an incorrect medical record, which has deprived me of my right to a fair hearing. The attached Suffolk Law Review excerpt underscores this point, stating, “The Court then held that the veteran’s right to a fair hearing was tainted by consideration of the erroneous medical record.”

Given the burden I continue to bear due to Dr. Jenny Jin’s actions, I believe it is appropriate for the medical community to take responsibility for her conduct. I request that you consider initiating a functional assessment to determine Dr. Jenny Jin’s fitness to perform her role in a competent, ethical, and professional manner. Should the assessment confirm her competence, I ask that Dr. Jenny Jin provide a sworn statement explaining why she replaced a diagnosis originally provided by a rheumatologist, a key element in my claim for service connection.

As a respected leader in the medical community, this case presents an important opportunity to examine the relationship between VA doctors and the AFGE union influence. Please ensure that unions are not influencing medical practitioners in ways that could result in the alteration of key medical records, potentially undermining patients’ claims for service connection.

Below is a list of the images attached to this letter. presented in chronological order so you can see how a key element in a veteran’s claim for service connection such as a diagnosis, was removed from the veteran’s medical record. What are the chances that Dr. Jenny Jin simply took it upon herself to invalidate that one specific key element, crucial for a veterans claim for service connection? How often does Dr Jenny Jin drive her family car in the wrong lane of the road ? This is why it is important to perform a functional test on Dr. Jenny Jin.
