Upon being contacted through a referral service for telemarketing a senior Advantel rep, Mark Honig set up an initial agreement. In which i was verbally told that if the appoiintments recieved did not meet my satisfaction or if both parties or decision makes were present I would not be charged for that appointment and it would not count toward my total number of appointments. Below is a copy of the agreement that was signed for service:

This Agreement made and entered into by and between AdvanTel, having an address of 700 West Center St., West Bridgewater, MA 02379 and _______ _________________(hereafter referred to as Client), having an address at ____________________ effective as of __________.

By this Agreement, AdvanTel and Client establish the terms and conditions of telemarketing services rendered by AdvanTel to Client.

The parties agree as follows:

1) SERVICES:

a) AdvanTel shall engage in telemarketing services for Client producing --- appointments, at a rate of $55.00 each, with a $100.00 set-up fee.

b) AdvanTel shall submit to Client leads, appointments or a database,

dependent on client's needs containing key results from client's program.

All such leads, appointments or database material shall remain the

exclusive property of client.

2)PAYMENT TERMS:

Total payment is due upon signing of Agreement. Under no circumstances shall services commence without prior payment. If additional services are required, payment shall be forwarded prior to commencement of additional services.

3) ENTIRE AGREEMENT:

This writing contains the entire understanding of the parties with respect to its subject matter and no modification, alteration or waiver of any part shall be valid unless given in writing and signed by the parties hereto. AdvanTel has made no representation or warranties of any kind. This agreement is governed by and construed in accordance with the laws of Massachusetts, excluding its' conflict of laws provisions. Thus, venue is within said state.

After the campaign began I recieved a excel sheet of leads that would be called from I went to the first few appointments where no one was present. When I tried to follow-up with them most of them remembered talking to someone but never agreed to an appointment. Nor were any of the people prequalified as we had discussed. My campaign manager, Christina Russel, suggested we change the script. After repeatedly recieving fake appointments I ask that my campaign be stopped.

I then suggested that I just eat the cost of the lead eventhough non of the appoinments I recieved were actual appointments. I was then told my campaign manager, Christina Russell, could not make that decision eventhough she was in charge of the campaign.

2 months after I requested to speak to someone about the issue every week for those 2 months I spoke to Dei Makenna in "customer service" and was told I could just get leads vs appointments after I repeatedly explained that I no longer wanted to do business with Advantel the following are the emails I recieved:

I spoke to Mr. Andre regarding your request, for the refund of the thirty one (31) due appointments. He believes that the best way to go, is to switch your program. As you know, you purchased the appointment program. However, we have what we call the perfect appointment program. What that means is, if you want the lead replaced for any reason we will do so, minus the customer service process with forms etc. If you don't sell it we'll still replace it up to 100% of the original order. If that does not interest you, then we are still able to do the credit for you. Please let me know how you would like to proceed.

As I mentioned before in my last email, we are willing to help you resolve this issue. However the options I mentioned are still the options that we have. We are able to switch your program from appointments to the perfect appointment program. Again the difference is, you are able to get replacements for ANY reason. If you don't sell it, we will still replace it. Or again we are still able to offer you a credit that is good for up to one (1) year. You are able to use the credit any time within that year, on any program. However as I have stated these are our options. Please let me know when you would like to switch your program. If not, then I will send you your credit immediately.

So eventhough i have repeatedly ask that the remaining appointments (not the fake appoinments I recieved) that I have not recieved be refunded and the relationship ended they refuse to give me my money back.
