I checked my Equifax credit report Saturday, March 26, 2005 and discovered on it an entry by BB&T, PO Box 1626, Wilson, NC 27894-1626. (Street address: 110 S. Stratford Road, Winston-Salem, NC 27113.)

According to the entry, I have an account with BB&T that is currently 120+ days past due.

That's outrageous, since I don't HAVE an account of any sort, type or description with BB&T!

Furthermore, BB&T is reporting a $0 balance and, in the comments section, the remark: "Closed or paid account zero balance."

It is patently absurd, illogical and irrational to report an account with a balance of $0.00 and a current status of 120+ days late. Not to mention: it's a RIPOFF!

This report, particularly the notation about being 120+ days late is likely to cause me to suffer adverse actions, vis-a-vis declined credit applications and higher interest rates.

I am mailing a certified letter, return receipt requested, to BB&T demanding that this item be deleted. If not done within 30 days of their provable receipt of my letter, I will file suit against BB&T for a plethora of violations of federal and State of Georgia laws, including the Fair Credit Reporting Act/Fair and Accurate Credit Transactions Act, as well as file a series of complaints against BB&T with appropriate federal and state agencies. I will demand a jury trial and will seek maximum statutory, compensatory and punitive damages, and attorney's fees. In other words, I'm not going to tolerate this sort of abuse.

BB&T has precisely two options: they can cure the problem or be sued.

The best thing to do is file a dispute with the credit agency that you checked your credit file with. If you contact BB&T directly, their going to tell you the same thing. I went through that exact same thing with another creditor and the item was removed from my credit report after filing a dispute with the credit agency (Equifax, Experian, and Trans-union).
