I work for Resurgent and if you are revieving letters for an account that is not yours than more than likely the person who had the account has your same name and there was a mix up while trying to get there info and we got yours insted. All you need to do is call and tell us. Thats it. We understand that we dont always get the right people. I am very sorry this happened and we do not intend to bother the wrong person. Gee, the bad old collection agency got an account or numbers mixed up? lol...happens a heck of a lot. I consider these type companies scoundrels and the bottom of my shoe has more respect than they do. :) If it's not your account, and you've sent them certified mail stating such, then that's that. However, if you want the harassment to stop, send them a cease communication letter via certified mail too. If they continue, by suing you, then you file a counterclaim against them when you file your answer in court. Another thing you could do would be to call Wachovia themselves and let them know this is not your account and that they need to look into this immediately. Let them know that if your credit reports are affected by this glitch, that they will be held liable for any damages you incur as a direct result of Wachovia's and their collector's actions.
