Sept. 2002 I entered into mortgage with this company. At the time I thought this company had the best interest rate. Had some employment problems and missed 5 payments in 2005. By end of December 2005 my account was given to their attorney for foreclosure action to begin. By Jan. 2006 had sent in missed payments and had entered into a forbearence agreement at that time. When contacted them in March they had only applied the $3500 I sent in to 2 of the missing payments remaining funds were being held in a special holding account-no reason given why. By May 2006 they indicated I still owed for 7 missed payments plus $1500 attorney fees. April 17th 2006 judgement order granted by local court to proceed with sheriff sale. When contacted them in mid-May 2006 they indicated by sending $6200 would stop the sale. At that time I begin to prepare a chapter 13 bankruptcy petition through my attorney. Petition was filed 5 days before sheriff sale was held. House was sold at sheriff sale, but due to bankruptcy filing sale was invalid-thank goodness. The last contact with Citifancial a Mr. Cannon indicated that my loan would not be reinstated if bankruptcy was filed.

The following is updated information to Citifinancial Mortgage Co. Following filing of chapter 13 bankruptcy and confirmation of plan. I was finally able to get a statemnet of accounts from this company. This statement was not sent to my personal address as I had asked several times, but was sent by a complaint I filed with the office of thrift supervisor which is suppose to oversee and regulate Citifinancial Mortgage. For some unknown reason the late fees and their attorney fees were removed from the proof of claim form which they were required to file with the court. It appears that if I had paid a Mr. Cannon the $6200 that he demanded that this money would be lost and not applied to my account. I guess the only way to deal with this company is through the Federal Bankruptcy Court.
