I signed in to your site tonight to get info on another company and was shocked to find one of the top stories was about Fairbanks Capital!

We are victims of their deceptive practices and are about to lose our home of 15 years. It started with a force-placed insurance dispute and payments being reported behind because they used mortgage funds for the insurance escrow. We entered a formal dispute with them never realizing how horrible it was going to turn out.

We are on the verge of filing Chapter 13 after this dispute continued for over a year during which time we were instructed NOT to pay our mortgage, that they would "suspend" the account until the dispute was resolved. What we did not know was that they reported us a rolling 90 days behind in our payments and have ruined our credit.

We are now going to hold off on our Chapter 13 filing while we determine if we can get included in a class action suit and get our credit restored and our mortgage back on track. Despite our attempts to resolve this "mess" we have not been successful.

I wish I'd stumbled on this back in February when we were tyring to refi and negotiate with this company. This knowledge would have saved me much time and stress and maybe we could have prevented them filing for foreclosure. I do feel better knowing I am not alone in this. I now have the info I need to fight (before this we thought something was fishy but had no proof). This company should be put out of business and every victim's home and credit restored.

So, consider this my formal complaint and I'm not going down without a fight!

I'm in double jeapordy that company is Ocwen so what ever you do don't use them either

Hey everyone, I hope to find that we are all still in our homes. I have been doing alot of research over the past few days. I want you all to click in your search bars and type in class action cases against FairBanks Capital corp. You will get alot of information from media coverage, pending law suits, and class action attorneys seeking info. from fairbanks mortgage holders and former employees of fairbanks. One of the news sights had an interview with a former employee who won't give her name but said they would have raffles in the office to who could get the most wetern union quick collects with in a certain amount of time. Stating that prizes would range from a big screen tv to a mini cruise and a $200.00 gift certificate to the mall. I believe it is Maryland channel 11 news. If you have windows media you can watch the news clips. I advise all of us to get as much info as we can because class action suits are forming right now. You only have to look for it. We are not allowed to post attorneys e-mail address or info. on this sight. So research people because the info. is as far as your keyboard. Post what you can so everyone else can see it. Also those of you who are facing foreclosure now definately look for those lawyers going after fairbanks because they might be able to order a stay until all the investigations are over. This has already been done in 2 states that foreclosure proceedings have been halted upon further investigations. As long as your still in your home fight. I also found out through an attorneys web sight my 2nd mortgage company is under litigation as a predatory lender another company I didn't pick my mortgage was sold to them to. So I'm in double jeapordy that company is Ocwen so what ever you do don't use them either. Wellsfargo just got done with a class action for predatory lending. Acorn.org an orginazation got several of those people different lenders to refinance them with a much lower interest rate. So if you can go to the web sight and complain about FairBanks maybe they can help some of us get refinanced to remeber strength in numbers. Our day is coming the wheels of justice are in motion. Keep praying and keep complaining to anyone who will listen. Take care all
