8/14/00; apply for Equity loan from EquiCredit Corp. close escrow 10 day's later 8/31/00 in violation of 4 sections of TX constitution, loan asigned to Fairbanks who try to foreclosed on my homestead.

I filed Bankruptcy in 2002 to protect my home and hired the law firm of Jan Shephard in Corpus Christ, TX where i live, this lawyer and his gang of CROOKS were represanting me and Fairbanks at the same time. Shephard did file an adverse motion to have the second lien avoided but the court keeps continuing the trail.

I am at the court house almost every week! I have a 5 inch thick file with Agendas, Select porfolio was given 90 days to end discovery, Trail was set for June 28, 2005 take a guess! Right; Select porfolio just decided to take my depositon and demended a continuance and the Judge allowed it! Trail set for July 28, 2005 I am not so sure it will happend.

Even though we requested production of documents; out 14 specific requests we were provided 173 pages of all the duplicates we have and non of the rest. Every single request was answer with, "Vague, overbroad, burdensome and harassing"

I need help from a lawyer because Select Porfolio want to take my deposition and "videotape" the deposition, have also exended invitations to the trustee, other attoneny's, stenographers and knows who else. if anyone out there lives in Corpus Christ, or near here I need all the moral support i can get, I am a senior

without any family, my husband died and we had no children. HELP!

In response to your conplaint......I too am a victum...This is what I have learned in the last 5 years...Possession is 9/10 ths of the law....you do whatever it takes to stop them.....it seems to me that the Office of Thrift Supervision in North Jersey is involved in this and I would even go so far as to say the Federal Trade Commission is also involved in this...You are going to have to sue these people on a Federal Level to get any results....Fire the attorney now and report them to the state bar a*s. they will send you a form to fill out..Make sure you keep all records and a journal of what is going on...I would not give a depsiton until I had all these matters streight....and the judge can only grant 3 continuances on their behalf as well as you can only get 3 continuances yourself....And all issues are addressed at the forclosure hearing...so when you get there make sure you have all you paperwork......the Clerk of Court residing over this matter will listen to your evidence and act accordingly...he or she acts as a judge on special proceedings like this.....I sure hope this helps you....But these people are governed by Federal Law and you will have to fight then on the same level......May God be with you!!
