long story. Refinanced several years back to re-establish my credit after becoming disabled. My mortgage was sold several times, the last time it was sold to Fairbanks Capital. Still on the books under original mortgage company. Had my home sold and out of the blue came a foreclosure? Lost the sale of the house filed Chapter 11 to safeguard my home. US Bankruptcy court declared that Fairbanks Capital did not have a prefected lien therefor bankruptcy was dismissed. Fairbanks used the original Mortgage companies name on the foreclosure. That kept Fairbanks out of the limelight thinking that no one ever would connect that company with Fairbanks. Now I find out the three mortgage companies work together on keeping high rate mortgages for the NYSE kind of like another Enrron deal. Before filing the bankruptcy I spoke in length with Fairbanks agreeing to a forbearance agreement in order to keep the sale of my house going. Forbearance was agreed but all of sudden the person I was speaking to was not longer available. Now just after the bankruptcy was dismissed I recieved a call from the loan servicing center on behalf of Fairbanks. Woman told me foreclosure sale is set for Nov. 7th. I informed the woman that Fairbanks does not even have a prefected lien How can it be possible to foreclosure when the bankruptcy court issued that order? I live out of the country and I am afraid that fairbanks is up to no good again. I was lucky the last time have no idea what they are capable of doing this time. Can anyone assist me?
