I signed a contract for a deal of 8 microdermabrasions
combined with the infrared light therapy treatments. A deposit of $101.00 was
charged to my debit card and payment arrangements were made for monthly debits
from my account to fulfill the total of $675.00. I was informed both verbally
and with a written document that I could cancel the contract for a full refund
within 3 days via letter sent certified mail. I got home and called my
dermatologist and then decided to cancel the contract. I sent the letter via
certified mail 5.5 hours after signing the contract at Forever Young....WELL
within the three days stated on their paperwork. I called a few days later and
they told me the letter was received on time and has gone into processing.
Their paperwork states it could take up to 15 days to receive a refund, so I
waited. I called 17 days later to ask about my status and was told it was still
in processing but had not been sent to accounting.
I have REPEATEDLY told them I want my money back and was assured it
was "in processing." I have kept asking during each phone call
"What is the delay?" And have kept getting the same response..."It's
held-up in the accounting department." I was also told "we will be in
contact with you to let you know what is going on." I have NOT received
one letter, phone call, email or otherwise, the entire two months they have had
my money. I was finally told that my refund has been denied; Incensed, I asked
Why and on what basis?
The corporate office gave a simple blanket statement:
We are no longer giving refunds on deposits. I find this despicable,
dishonest and ILLEGAL, as I SIGNED A CONTRACT that states otherwise. After
researching this company, I have found numerous, numerous, complaints of the
same vein. I believe their BBB rating was once at F. I filed a complaint with
the BBB of Oregon and a dispute with my bank. I was also told by a lawyer that they are definitely in breach
of contract and that they cannot arbitrarily decide to keep my deposit two
months after the fact. If my bank can't get my money back. I am getting the lawyer to do so. I WILL GET MY MONEY FROM THESE CROOKS!

This sounds to be an isolated case; my sister and myself have purchased tanning and spa packages that we later changed our minds about and had no problems getting our refund. It did take the couple weeks that was stated it would take, however, I was also given an in store credit and a free tan while I waited!
We have since purchased more and were allowed to use my in store credit towards this, for a very large savings. The 3 day cancellation policy is the same at other tanning salons, so I dont see this as an issue either....

After filing a dispute with my bank and with the Better Business Bureau, I was refunded my deposit money....2 days shy of TWO MONTHS after I signed the contract.
