We my husband and I signed two contract with Larry Turner of Home Craft Vinyl Siding & Windows to perform Exterior and interior home improvement to our house, we recently found out from a mortgage auditor, that the loan Larry Turner arranged to finance our home improvement project was in violation of many state laws. He steered us to a predatory lender, overcharged us for sub-standard work and fail to complete as agreed. Here are some of the violation they committed. Pertaining to our home at 6418 S 13110 E Road Saint Anne, Illinois 60964.
It is our intention to file suit against all parties applicable to seek damages we incurred as a victim of Predatory Lending practices.
Regulations that have been set in place to protect the American consumer. These include but are not limited to, the Truth in Lending Act, (TILA), Consumer Protection Act, Real Estate Settlement The mortgage note [on our home as referenced above] is in violation of laws and Procedures Act, (RESPA) at 15 USC 1601 et seq. and 12 USC 2601 et seq., the Home Ownership and Equity Protection Act or (HOEPA), the Home Mortgage Disclosure Act or (HMDA), the Illinois Complied Statutes, the Illinois Consumer Fraud and Deceptive Business Practices Act (ICFA), 815 ILCS 505/2, the Illinois Consumer Fraud Act, 815 ILCS 505/1 et seq., the Illinois Residential Mortgage License Act, 205 ILCS 635/1-1 et seq., and Regulation 38 Ill. Admin. Code part 1050. Our rights as consumers have been grossly violated.
The year of our loan is January 09, 2004 and is not beyond the statue of limitations.
1. On or around October 1999 we contacted Home Craft Vinyl Siding & Windows after reading their advertisement which stated 100% financing available, to do some exterior remodeling, new siding, windows and roof repairs to our home. Larry Turner, the owner of Home Craft Vinyl Siding & Windows, who without our knowledge, is not a licensed roofer in the State of Illinois, took our information for the loan application. On November 11, 1999 we signed a contract for the work; Exhibit A, Proposal of work for $21,500, dated 11-8-99. We were not shown the price of the work until he had us approved for the loan. We thought that the financing would go directly through a Bank. Without our knowledge or consent, Larry Turner gave our information to a Mortgage Broker who we never met and never made application with nor did we ever receive any mortgage disclosures from. We believe that Larry Turner conspired with a Mortgage Broker who could charge us whatever they wanted to get us the loan, again without any disclosures; an appraiser who would appraise our home for whatever amount needed to close the loan; a Title Company that would insure that Larry Turner of Home Craft Vinyl Siding & Windows would be paid in advance of performing his sub standard work and a Lender who would allow this and accept the fruits of the Frauds. We have never received any of the mortgage documents we signed at the closing, we did not receive a copy of the appraisal nor did we receive 2 copies of our Right to Cancel the loan in violation of the Truth in Lending Act, (TILA), Consumer Protection Act, Real Estate Settlement Procedures Act, (RESPA) at 15 USC 1601 et seq. and 12 USC 2601 et seq., the Home Ownership and Equity Protection Act or (HOEPA), the Home Mortgage Disclosure Act or (HMDA), the Illinois Complied Statutes, the Illinois Consumer Fraud and Deceptive Business Practices Act (ICFA), 815 ILCS 505/2, the Illinois Consumer Fraud Act, 815 ILCS
505/1 et seq., the Illinois Residential Mortgage License Act, 205 ILCS 635/1-1 et seq., and Regulation 38 Ill. Admin. Code part 1050.
2. Without realizing that the work that was done on our home the 1st time by Larry Turner of Home Craft Vinyl Siding & Windows was sub standard, we contacted him again in November of 2003 to do interior remodeling in our home. On December 10, 2003 we signed a contract for the work; Exhibit B, Proposal of work for $24,800, dated 12-10-03. We were not shown the price of the work until he had us approved for the loan. We explained to him that we never received any of our closing documents from the Mortgage Broker from the 1st closing. He told us that he had nothing to do with that and we told him make sure that we received it this time. Once again, Larry Turner took our information for the loan application and once again without our knowledge or consent, gave our information to a Mortgage Broker, Dan K. of Illinois Mortgage Associates, who we never made application with nor did we ever receive any mortgage disclosures from until the loan was closed. Once again, we believe that Larry Turner conspired with the Mortgage Broker, Dan K. of Illinois Mortgage Associates who could charge us whatever they wanted to get us the loan, again without any disclosures; an appraiser who would appraise our home for whatever amount needed to close the loan; a Title Company that would insure that Larry Turner of Home Craft Vinyl Siding & Windows would be paid in advance of performing his sub standard work and a Lender who would accept an inflated appraisal and accept the fruits of the Frauds in violation of the Truth in Lending Act, (TILA), Consumer Protection Act, Real Estate Settlement Procedures Act, (RESPA) at 15 USC 1601 et seq. and 12 USC 2601 et seq., the Home Ownership and Equity Protection Act or (HOEPA), the Home Mortgage Disclosure Act or (HMDA), the Illinois Complied Statutes, the Illinois Consumer Fraud and Deceptive
Business Practices Act (ICFA), 815 ILCS 505/2, the Illinois Consumer Fraud Act, 815 ILCS 505/1 et seq., the Illinois Residential Mortgage License Act, 205 ILCS 635/1-1 et seq., and Regulation 38 Ill. Admin. Code part 1050.
3. We were steered by Larry Turner of Home Craft Vinyl Siding & Windows to
the Mortgage Broker, Dan K. of Illinois Mortgage Associates which we did not
talk with or meet before he closed our loan on 01-09-2004. We were never presented nor did we sign or receive a Loan Brokerage Agreement with Mortgage Broker, Dan K. of Illinois Mortgage Associates in violation of Section 1050.1010 Loan Brokerage Agreement.
