DOES ANYONE HAVE ANY INFORMATION REGARDING ANY PENDING CLASS ACTION LAWSUITS AGAINST AXIN FINANCIAL? DOES ANYONE HAVE ANY ADVICE AS TO HOW I CAN GET SOME RESULTS? I WOULD LIKE TO GET THIS CROOKED, DISHONEST COMPANY OUT OF MY LIFE. EVEN THOUGH IRVINE WEBWORKS CANCELLED MY WEBSITES, AXIN FINANCIAL CLAIM I OWE THEM MONEY. THEY PAID IRVINE, NOT ME! IRVINE WEBWORKS GOT PAID IN FULL FOR SERVICES NOT RENDERED. I DON'T UNDERSTAND WHY AXIN FINANCIAL ISN'T GOING AFTER IRVINE WEBWORKS TO COLLECT THIS UNEARNED SERVICE REVENUE.

This merchant account was established in March 2004. The merchant was referred to Innovative Merchant Solutions by independent sales office called First Merchant Resources (FMR). Innovative Merchant Solutions does not work with National Grants or work from home internet based businesses. Those most likely were other companies that FMR referred the customer to. Once this customer's account was established, it was online and available for processing at any time, 24 hours a day. Because we do not have a connection with, or maintain the websites in any way, we were not aware that there were any problems in that regard. After the account had been opened for some time, the owner contacted Innovative Merchant Solutions and advised a representative that she would be moving to a new web hosting company and offering a new line of products. We accommodated this request and noted the account. Later, the merchant contacted Innovative Merchant Solutions and advised us that she was no longer interested in maintaining the account because the websites had not generated any sales. Although we sympathize with this problem, this issue is something that is completely out of our control. Upon request for closure the account was terminated and the $295 Termination Fee noted in Section 4.01 of the Merchant Agreement was charged. This Termination Fee is not only listed in the contract, but also on the section just above the signature line on the Merchant Application. That section states If Merchant is approved and elects not to process with IMS and/or cancels the account within six (6) months of approval, Merchant will be charged a $395 cancellation fee to offset IMS' costs of setting up Merchant's account. If cancellation and or termination of the Merchant Agreement occurs after six (6) months, Merchant will be charged the standard termination fee. Therefore, Innovative Merchant Solutions has provided all contracted services, worked to accommodate the customer's changing needs, and acted within the scopes of the contract. If there are separate issues regarding the operation of the website, we suggest that the provider of those services be contacted directly for assistance.
