I purchased a ball gown for my daughter to wear to her Military Ball. It was beautiful (notice I said WAS)white with small splatters of silver covering the dress. Well, when she returned home from the ball only half of the glitter remained on the dress. She was extremely upset considering she loved the dress.

I went to the JC Penney here in Mobile, AL and told them I would like to return the dress due to the nature of the problem. I explained to the clerk that the dress wasn't any good anymore and couldn't be worn again. She told me under no circumstances were they allowed to take back special occasion dresses. I reminded her that the dress had only been worn once.

The woman went and got her manager whom told me the same thing except that my daughter had gotten the intended use out of the gown and that she wouldn't ever wear it again anyway. She also informed me that if they took back every gown that something happened to the first time it was worn they would have to take them all back.

Way to go JC Penney. You won't be getting any more of my money and yes, I will tell as many people as possible.

This was a special occasion dress.. for a military ball. It would be like returning your prom dress when prom was over, or returning your wedding dress when all was said and done. The dress served its purpose and gotten worn.

Unfortunately, a few bad apples can spoil it for everyone. Most stores have this policy to protect themselves against fraudulent returns, and it is honest people that have to suffer for it.

I fail to understand your point here. Let's say that the dress was perfect in every way. Your daughter wore it and enjoyed it immensely. After the formal event was over, she put the dress in her closet and never wore it again, because after all, it is a special occasion dress and is not something that is likely to be worn ever again for anything. OK ... In this case, your daughter wore the dress, was NOT happy with it, however the evening continued and the formal event ended, and the dress is never to be worn again. See the point? In each instance, the dress served the purpose for which it was intended, and it is now hereby considered "useless" for any other purpose. So, your attempt to get a refund appears as though you were simply trying to "rent" an expensive gown, knowing that it would only be worn once and not wanting to spend good money on such a thing. The store will not take it back because there are customers out there, believe it or not, that will cause damage to such a dress in order to try to weasel a refund out of the store. No returns on special occasion dresses, period! If you don't like it, learn to sew and make your own dress. I'd suggest to shop elsewhere, but that would not be feasible because EVERY store has the same policy on special occasion dresses. Best wishes!

Haven't you heard about women who will buy a dress wear for whatever it was intended for and take it back. Are you sure that if you bought that same dress at another department store, they would take it back. I thought is was known that it would not be taken back from any department store. They probably have a bad enough time trying to sell this inventory, they are happy to get rid of it. What did you mean by falling apart? Glitter comes off all the time. Did any seams come out? Was the dress okay otherwise? JCPenney is a great store to shop. Granted maybe the people aren't great but JCPenney as a whole is a great place to go. Get over it and go on!
