Keller Williams Franchise KWI-8, LTD, sued us, nondisclosure, damages to customer, misrepresentation, lied about square footage, fraud Austin, Texas
My husband and I hired an agent from Keller Williams Realty. This is what happened as a result:
When we purchased our home we did not know that the listing agent had chosen, all on her own, to add an enclosed sun porch to her MLS listing and represent this space as Gross Living Area (GLA). She called the seller of the home and asked him how big the sun porch was. He told her it was "about 450 SQ FT". She did not measure or confirm, instead she took this wild guess and added it to what TCAD, Texas Central Appraisal District, had on file.
She listed the home we bought as 2028 SQ Ft, despite TCAD having 1578 Sq Ft on file.
What is even worse is that this addition was built without a permit, in a drainage easement. The agent still represented it as GLA.
Our buyers agent, who worked for the same company and in the same office as the listing agent, knew what the listing agent had done but failed to disclose it to us.
As a result, we grossly overpaid for our home.
Once we realized what happened, which was after we were living in the home, we hired a real estate attorney to try and help us recover our damages.
The company counter sued us for a frivolous lawsuit.
We lost the suit and were sued by the company we hired to protect us in our home buying experience. We were sued for $157,000, to be exact, for their attorney's fees.
We know this sounds outrageous but this is what happened.
