Due to Spurgeon Green III's inactivity and the courts incompetence,my driver's license is still in limbo. I have done the years revocation period but, the state of Delaware does not play ball with the state of Georgia on these matters.Delaware requests a "Certificate of Completion of Sentence to reinstate my license. Georgia requires same document along with the DUI school and $200.00 I have stir up someone to obtain said document(s),correct? The atty's office couldnt seem to do it.Calls to the respective DMV offices came up with equally useless information and officials that didnt seem to know the answers to my questions or which direction to point me in.

It appears as though this attorney also has an office in Macon Georgia (or used to have one, or has recently moved there). If the office you were contacting is no longer in existence, I would suggest trying to track him down in Macon. Your attorney taks no part in a grand jury proceeding, and until an indictment is handed down, there is not much sense in doing anything with your case. If no grand jury was convened in October of 2003, and none has been since, I would assume that the case has been dropped. You probably shouldn't assume that, but there isn't much you or your attorney can do until it is known whether grand jury proceedings will be conducted. Nonetheless, it is unethical for an attorney to keep his client in the dark about a pending case. In fact, this is the number one complaint regarding attorneys received by bar associations nationwide. I would not recommend taking legal advice from a paralegal, especially in regards to a criminal matter. And I would definitely question the scruples of a paralegal in the employ of an attorney who offered to give you her own assistance for a fee paid to her. Consider this: if you file a motion to dismiss the case for lack of prosecution, you are asking for an injunction forcing the prosecutor to drop the charges because an indictment hasn't been sought. How does the prosecutor defeat this motion? By seeking an indictment! Do you really want to pursue an injunction that could result in prosecution that otherwise may not have happened? I don't know the particulars of your case, but I would generally urge caution when trying to back a prosecutor into a corner.
