LWC TRANSPORTATION/BRIAN LINDNER Owes me $1,500: Pays me as a private contractor & doesn't provide statements for compensation; won't acknowledge my information & verify it. STARKVILLE Mississippi
I have 7 years OTR experience, a good portion of that as an owner/operator. I have been driving for Brian Lindner/LWC Transportation since Feb 2005. To this day: 11/5/05 he has not provided me with statements for the work I have done. I have asked several times and he refuses. I believe that if you are paid as a private contractor (Driver) that by law he has to provide something in writing pertaining to my compensation. (ie-loads hauled, miles paid, reimburements, advances taken & any other deductions). Am I wrong on this?
All of my information for every load I have hauled is written on a pad and then entered into a spredsheet (Microsoft Excel). I also keep records of every advance taken and any money that I spent out-of-pocket for his truck to be reimbursed. I also keep track of any money put into & taken out of his truck petty cash. In other words I have documentation to prove evrything I have done since I have been driving for Brian Lindner.
My records show he owes me $1,500. From where, I cannot figure out because he only sends me checks to the bank or direct deposits the money w/o any documentation. I don't know which loads I have been paid for, if the pay mileage is correct, if he has taken the correct advances out or reimbursed me, etc. I have accounted for every check sent to my bank and the total pay to date is off by $1,500.
He refuses to check into his books and verify my information and keeps insisting I am wrong. Is it not his job to verify and prove to me he has me paid CORRECTLY to date? Especially after I have given him all the information provided to me and sent it to him? (thus proving he still owes me). In other words I have jumped through his hoops to give him all he wants & still insists on more information to throw me off and perhaps make me give up. He now wants me to obtain copies of the checks from my bank he sent to me (which costs alot of money over 10 months). That does NOT prove he has paid me correctly. It only shows what he has paid me so far!
Also, Brian has repeatedly not paid me ontime or "forgotten" to pay me. Because of this he has kept me broke, caused me to constantly pay my bills late, has caused my bank acct to become insufficient because the checks were supposed to be deposited, etc.
I have several other problems with Brian Lindner/LWC Transportation that I will add at a later date.
I would appreciate any help, info, advise on this situation. As of tonight 11/6/05 I have resigned from LWC Transportation.
