Mann Bracken has been leaving messages on my answering machine for the last three months. I sent them a certified, return receit requested letter to cease calling me, but it didn't do any good, because they have ignored the letter and keep calling me. What should my next step be to keep these a-holes from calling every day?

Doug, How you send the certified letter is very important. Send another one this way. It is very important that you put the certified# on the letter itself, and keep a copy of the letter for your records. This proves WHAT you sent. Inform them in this letter that any further violations of your rights under the FDCPA will result in an immediate lawsuit being filed seeking the maximum of $1000 in statutory damages as allowed by law and court costs, legal fees, and actual damages. Specify on the letter that this is your second request, and cite the certified# of the previous letter. Also, get their fax #'s and send several copies of the letter. Usually 300-500 copies gets the job done. Then they cannot say they didn't get it. Doug, If they ignored your cease communications request, winning a lawsuit is a slam dunk if you have the proof you sent it. Under the FDCPA, you are entitled to up to $1000 in statutory damages, plus legal costs and actual damages. In almost every case, these get settled out of court. You can easily squeeze $2500 out of them if you work it right. Don't get mad, get paid.

In addition to the settlements, the law firm has also agreed to destroy any unlicensed software, purchase replacement software, and strengthen its software management policies. Like most BSA investigations, this case began with a call to BSA's hotline: 1-888 NO PIRACY. Typically, after an initial investigation of the lead, the BSA contacts the company reported, although in some cases it pursues a software raid. In the case of Mann, Bracken, Layng & Kenzo, it voluntarily conducted a self-audit and reported the results to BSA. "Firms ought to pay careful attention to their software management as they do to other aspects of their business," said Bob Kruger, vice president of enforcement for the BSA, the software industry watchdog group. "By establishing and implementing sound software management practices, law firms can avoid paying stiff penalties to BSA. BSA received full cooperation from Mann, Bracken, Layng and Knezo and we were able to move quickly toward a resolution." James D. Branton, of counsel to Mann, Bracken, Layng & Knezo, said, "Mann, Bracken, Layng & Knezo has always been fully committed to software copyright compliance and once the extent of the problem became known, it took proper action to resolve the situation." Recently, the Business Software Alliance announced the results of a state-by-state analysis of software piracy in the United States and the overall outcome of the study reveals piracy's continued negative impact on our nation's software industry and economy. A key finding in the study was that the highest increase in piracy occurred in Georgia. The piracy rate has increased 49.9 percent in two years from 17.2 percent in 1997 to 25.8 percent in 1999. As a result of this finding, BSA is launching an educational radio campaign reminding businesses about the importance of sound software management. According to the study conducted for BSA by International Planning & Research Group (IPR), in 1999 software piracy cost the United States $3.2 billion in retail sales of business software applications and 106,000 jobs.
