Prior to entering a contract, David Liakis of Premier Renovation represented that his company was well capitalized and in good financial standing. During contract negations, Liakis informed my attorney that he was concerned about his reputation and he was expanding his work to do more and more business so the preservation of his "good name" was important.

A contract was entered into with Premier Renovation 4-26-07.

Premier was to perform a home remodel.

Premier was to receive a 21% fee for performing the service of General Contractor. This fee was to be paid in stages, at the time that draw payments were made to subcontractors and suppliers.

Payments were to be placed in an escrow account and dispensed through a title company.

A deposit check was requested by Premier, which was given to Tom Brennan on 4-26-2007.

On approximately July 19,007, Tom Brennan, who previously represented himself as an ower of the company, informed me that David Liakis was the sole owner of Premier Renovation and that David Liakis was planning on closing the company. He informed me that hundreds of thousands of dollars were owed to trades and suppliers.

Over the subsequent 2 weeks, the following occurred:

1. We discovered that the deposit payment for our project was never placed in escrow. We requested confirmation of this from David Liakis, and if the money was not placed in escrow, we requested that he do so promptly.

2. We found that minimal expenses for our project were paid, ; and that David Liakis reportedly used our deposit for "general operating costs" of his company. We requested a breakdown of all expenses owed, and paid. This was not provided.

3. We never received a sworn statement from Premier prior to obtaining any payments in accordance with secti our contract, and/or as it states as required by law.

4. We never received a sworn statement prior to the first disbursement in accordance with our contract.

5. Various trades and suppliers informed us that they had not been paid for work or supplies on our project, as well as multiple other homes that Premier was the contractor on going back several months.

6. I was informed by 2 other homeowners that they paid Premier hundreds of thousands of dollars, and that most of the trades and suppliers were not paid for their work going back several months.

7. A lien was placed on my home due to non payment of work; payment for which was to be paid by Premier out of the deposit.

In the interim, our remodeling project was poorly managed and not cleaned, repetitive errors were made despite repeated reminders, some of the work was not consistent with code, and Premier was unable to get the necessary trades to come to the project to perform required work.
