I don't know what to do. About a week ago I was contacted by Davis Law Associates claiming to represent Bank Of America in an attempt to collect a debt in the amount of 4,800 dollars. Well I didn't think anything about at the time, because I do have an old outstanding debt with Bank Of America, only the debt was for less then half of what they were claiming I owed. I told the guy I was speaking with that I would get back with him in a couple of days, because I needed to figure out what I was gong to do.

I started researching Texas laws regarding debt collection, lawsuits, and judgments, because I simply did not have the money, or the resources to acquire the money. After reading my rights under the FDCPA, I decided contact them back and ask some questions. Well, they went from nice to very rude when I started questioning the difference between the original debt, and the amount they claim I owe. They me that they were under no obligation to give me any information about the debt, other then the amount owed, that their only obligation was to take payment, or start legal proceedings.

Then when I asked them for their address so could exercise my right in writing, to request debt validation, they got down right belligerent. They told me I don't know where i got my legal information from, but I had been miss informed. They told me I forfeited my rights when the debt went delinquent. They even had the nerve to tell me that I am not supposed to show up for the hearing unless I have an attorney (knowing full well that if I don't have the money to pay this debt, I don't have the money for an attorney either. They also tole me that I would not be allowed to say anything in my defense if I did show up.

When I told them they were in violation of the FDCPA, they told me I need to get an attorney and they hung up on me. After everything I've read about them, I now have my suspicions as to whether or not Bank Of America has anything to do with this. They have not even contacted me in writing, I am not even sure they have my correct address. I don't even know how to proceed with this situation. I need help.

I hope this helps. These people have two offices. One at 380 Steven Avenue, Suite 205, Solana Beach, CA ( have no ZIP ), and the other is 2655 Camino Del Rio North, Suite 203, San Diego, CA 92108. I have two phones: 800 600 2610 and also 866 204 3699. There are several people who call the consumers but I believe the primary person calling is Mr. Frank Munoz alias Mr. Mike Smith - may have other aliases.

That 800 number, and the number that they constantly call me on, are both tied to Davis Law Associates. I know what the recording says when you call the number, but since they refused to send me anything in writing, or give me their address, I had to search for them, and since I wasn't exactly sure on what the name actually was, I searched with the two phone numbers. I started with the BBB, and information on Davis Law Associates came up on both of the numbers. I went to Google, and the same exact thing, both numbers bring up Davis Law Associates. Every single search engine I entered those two phone numbers in, brought up Davis law Associates. Whatever Lawyers name is mentioned on that recording when you call either one of those numbers, doesn't seem to exist. It isn't a matter of me not having my information correct, I am going on the only information I have available to me. Do your own search, inter the 800 number, and 619-299-1709 which is the number they have been calling me on, to a few search engines, you tell me what lawyer's information comes up.

A search of the state bar of california, found only one Russell a davis, at the address I provided. Its possible, that he might have another office where collection is done, so as not to let some of his clients know his side business, that way if you or another business type need to go into the office you won't hear the way these collectors talk to people. As a client, your lawyer doesn't tell you all that he's involved in. There are several number with this collection agency. Rhonda call the Attorney complaint hotline at 1-800-843-9053, make a complaint against DAVIS Law Assoc. and give all the different numbers they have. and they will be able to tell you if this Lawyer is using Two different offices Use the address that I provided and the one you have listed, send a debt validation letter(RRR)also tell them no more phone calls, everything must be done via the U.S.Mail, keep copies of everything you send and do not sign anything, these are some of the different phone number other have stated are used by Davis Law Assoc: 619-299-1709 800-600-2610 ext.382 800-478-5541 It possible with some of these collction agencies to have several lines coming in and not all the phones are answered the same. Rhonda, this guy on the phone that told you, you lost all your rights to dispute this debt, is a moron, check and see if your state allows one party taped phone coversation, if so record these people. I am a client of Mr. Davis. He is a business Attorney. The phone number and address do not match. Your complaint. I called the 1 800 number you listed and it is with another law firm. That's why it is important that you get your information correct before you post it. David is not Davis.

I appreciate your input. I don't understand why and how these collection attorneys get by with this stuff. Doesn't the courts realize that they are sending summonses to old addresses where the defendant would have no knowledge of a hearing. When they talk to you on the phone, they make no effort to verify whether your contact information is accurate, and if you attempt to give it to them you get hung up on, or they act like they are updating it but don't. Getting any action taken against people like this is very difficult, and that just isn't right.

I am not sure what is going on here, but when i call both of the phone numbers. The one they gave me to call, and one they call me on.......which are the exact same phone numbers listed for Davis Law Associates, it says it's the law offices of David Sean Dufex, I am not even sure if that is spelled correctly, since I have nothing from them in writing. I can't find any information at all about this attorney, all of my searches keep leading me back to Davis Law Associates.

Since, you have their address send them a letter (RRR) that you want them to validate this debt, also tell them that, due to there employee, rude, unlawful and illegal advice I want no more phone calls, all communication Will be by US.Mail. Pull your credit report to see if they place this debt on your report and pay close attention to the dates. A open account in Texas is 4 years on the statute of limitation, from the time of default and a debt of this type can only be reported for 7 years on your credit report. This is a new low for an collection attorney, File a complaint against him with the calif bar assoc. and the calif state attorney general office, put as much detail that you can in the complaint. even if it wasn't the lawyer who called he is still liable for his employee's action. Don't expect much back in the way of validation, what you don't get, if it goes that far, you can get during discovery, they must have a sign contract to sue you in court and it must be within the statute of limitation, if they file suit, thinking they will get a default judgement, make sure you look up your state rules and law and countersue. Since you already stated you should look up Texas rules of civil law to get to know them better and to know what must be done: main ones to look at are, Rules for pleadings, discovery, interrogatories, request for admission, and some on rules of evidences, especially when it comes to these sworn affidavit of accounts these lawyers file. Most are suspect anyway On of the things collection lawyers do is called sewer service is they send an summons to an old address, especially if they know they can't produce a signed contract or out of statute debt, so make sure when you mail your letter they have your correct address, it better to deal with this up front then, to get a judgement vacated. goolge credit infocenter and buh hibbs both have some good information on collection lawyer and agencies and how to deal with debts and the likes. Also if you clerk of courts have a web site, once a week check it to see if your name comes up within the civil docket, most counties have such a web site, where you can view the entire docket by name or case number.
