EVERYONE MUST WRITE NOW. Sedgwick is using shotguns against sparrows. AT&T is either asleep at the wheel or colluding in this.

AT&T's 2007 Employee Welfare Plan (Disability Plan) (shrewdly?) does not list the definitions of and accountabilities of the organizations involved in the Plan as did the former AT&T plans.

The fact is that Sedgwick is stretching the standards for the Insurance Industry as a whole. They are ambitious and think they are going to keep getting 22% + growth and AT&T is going to get double digit profits and still keep draining the disability trust with these outrageous expenditures against participants.

AT&T has forgotten the basic purpose and the CEO's role in providing a Disability Plan. As such, has forgotten--if he ever thought about it to begin with---- the potential vulnerabilities. They are not above the law.

AT&T as the Fiduciary and Plan owner is responsible to act:

"Solely in the interest of the plan's participants and Beneficiaries"

And

"For the Exclusive purpose" of providing benefits

And

"Defraying Reasonable expenses of administration.

ERISA 404(a)(1)(A).

This rule is based on the

Common law trust duty of undivided loyalty.

(Does it feel like that? noooooo!)

There has been legislation passed that says that a claims manager

Cannot be the judge and jury. So, check out your

Legislation and do not be bullied by these bastards.

AT&T has about 5000 people on disability, They are using 6 and 12 month reviews. (Excessive? Nah, AT&T is making lots of money in Wireless.)

What are they up to? Getting people off disablility who are certified disabled.

But yet, the woodpeckers peck. Put hundreds/ thousands of nasty claims agents who are paid $15. an hour, send harassing, intentionally meanspirited, cruel by training ( standard operating procedures are the the key words here) letters and be abusive, push every expense to plan participants to make their costs look low, utilize our doctors time until our docs get really mad and no longer want us and we have to switch to someone who no longer knows our case and cannot support our disability as strongly...., absorb disabled peoples' lives with letters and phone calls constantly wanting more information that was just sent in; in your face tactics......yes be in participants lives make them constantly think about their livelihood, make sure that they doon't invest their money because they are afraid that you are taking away their money next month, don't allow them to donate to church because they are afraid of the pending financial cruelty , they don't do and they don't live anymore, they are paralyzed...

This is AT&T's Third Party Administrator? Make sure that participants worry, worry, and worry. Just keep pushing the boundaries and watch those Sedgwick growth numbers go up, up, up. They find every way on the edges of the" legally correct" Plan to hurt participant and every six and 12 months more fall off the roll. ( Forget about the right thing to do). They go much further on high paid participants .

SEDGWICK AND AT&T TOTALLY ABANDON THE PURPOSE OF THE PLAN.

Just keep writing letters to the FEDERAL GOVERNMENT. knock, knock on Mr Stephenson's door, maybe one day he will open it and understand what his agents and his organization are doing. Right now, he is deaf, dumb & blind or COLLUDING.

I have requested my attorney file an 'administrative complaint' with the Department of Labor regarding the flagrant ERISA violations in my recent termination. I have also been in contact with class action attorneys. I also encourage all to contact US Senators. Not only from their own states, but national figures as well, particularly Senator Charles Schumer and others active in ERISA legislation. AT&T has been made aware, by many of us, Sedgwick's ERISA transgressions and imprudent fiduciary management of Plan assets. They are just as responsible as Sedgwick at this point. It is only a matter of time before momentum by harassed claimants leads to significant legal action against both of them. One of the other posters here has started a yahoo group regarding classactionsedgwick. Still very early, but a place to share information!
