The first statement is false and libelous slander. Since incorporation in 2009, this is the only small claims case of which Arizona had no jurisdiction due to our corporation having no significant activity in the state of Arizona. She's the lone wolf, here.
Her statements of being a misleading company are also false because we do provide our terms and conditions to any client who may ask. Our rates are answered honestly and truthfully. We are one of the few software companies who will bill you by the minute with no minimums.
Her claims of failure to complete tasks are also untruthful and misrepresented by her own confession in court. She was all over the place with demands to complete tasks that were not even ready to begin. She admitted in court to asking work be preformed and then publicly deny she made those requests.
In her Site Operations Management Service, we DID explain to her in great detail that our billing cycle was bi-weekly. An issue may exist for long periods of time until that specific issue is complete. Any and all work efforts during that time were referenced by the issue ID as a LINE ITEM on your invoice. Obviously, issue id's may appear on several bi-weekly invoices as work is expended to complete the task.
The next fascinating item comes from our rebuttal made on her previous ripoffreport. Mrs. Jane Weisner was informed that we would not tolerate her logging on and manipulating comments posted by our staff on her issues. Our extraction of the mantis DB has preserved her activity to this very day. Way to bend the truth, Mrs. Jane Weisner.
This next statement of access to the tracker relates to the $25/mo service fee to enjoy access to development tools such as the mantis BT tracker and subversion repository. She canceled her monthly access as was told to access via subversion before the month ended. She thought we should train her to use subversion free of charge.
The description of Site Operations Management which we explained to this client long long ago controls the development site on our server while work is in progress and unpaid. At any time a client request transfer of paid work, we will certainly oblige and provide a zip file or charge our time to transfer it for them.
Mrs Jane Weisner is publishing false statements about work estimates. Several times we told her that for set objectives we estimate and never quote flat rates. She began introducing other objectives and then when her designer made two obvious flaws did not agree that we should charge her to begin anew from the corrected design as if it were our fault and we should bare the burden of cost for her designers mistakes?
We have learned from our mistakes Mrs. Weisner. You now must sign a personal financial responsibility form if you are a corporation, LLC, partnership so that our collection services can track an individual. We revamped our terms and conditions to prevent personalities such as yours from abusing our hard work.
Again we must address her claims of stopping work. Because it is a matter of public record, TrashyCat LLC repetitively failed to pay their invoices on time. It was not until the 3rd and final notice and phone calls that their company would honor their late invoices. Every time, our notices due notify the client that their services shall be suspended for failure to pay on the due date.
Each invoice is detailed by line item. Each line item contains a tracker ID when you are a SOM client. You can enter the tracker ID from the line item to see a full history of activity in the specific time frame the billing cycle covers. At NO time during an active SOM subscription is a client prohibited or limited from reviewing those line items.
It's expensive to go to civil court. Every small company has faced this type of client and it's such as shame there are no other affordable means to impute damages back on them. This woman and her company continue to be untruthful and unethical.
