On March 28, 2014, we shipped out 3 boxes containing 200 cellphones and 1 box containing 18 tablets to Technollo using Technollo's FedEx shipping bar code and account number provided by Keith Allen representative and contact person at Technollo. 

We were then informed by Technollo that one of the boxes containing 87 of our cellphones was not received by them. Upon further investigations, we were informed by Technollo that FedEx had misplaced the box containing the phones and that we needed to file a claim with FedEx. So we contacted FedEx and tried to file a claim but were informed by FedEx tracking and claim divisions that Technollo was actually the party responsible for filling the claim and or tracking the missing package. 

FedEx claims dept said that by Technollo providing us with their FedEx account number to use for the shipping they essentially took possession of the package at shipment and thus they are legally the Shipper and Receiver of the package and responsible for tracking the package or filling a claim if it can't be found.

For the next couple of weeks, we went back and forth in discussions and email exchanges with Keith Allen of Technollo to try to reach an acceptable sale price for the phones and tablets they had received from us. 

However, we were not able to come to a satisfactory agreement on the purchase price for our phones and tablets. Then suddenly on April 25th, 2014, while I was away travelling, Keith sent an email saying that they were mailing us a check for an undisclosed amount for the 113 phones and 18 tablets in their possession with no mention of the 87 other missing phones. Upon my return, I notified Technollo that firstly we had not received any check and would not be accepting any check payment from them as we had never agreed to any amount for the sale of our phones and tablets either verbally or in writing. 

I then requested as per our agreement that they please return all our phones and tablets in their possession in the same condition and packaging as we sent it to them since we were not able to reach a satisfactory arrangement on the sale price. They also needed to follow up with FedEx to sort out the missing box of 87 cell phones as they are legally responsible to us for the missing phones.

Again, according to FedEx claims and legal agreement with Technollo - by providing us their FedEx account number to be used for shipping they essentially are the shipper and receiver and therefore the only authorized entity that can contact FedEx to get our phones back or file a claim for the value of our phones. Since then all attempts to speak to Keith or any other senior representative at Technollo has been met with "stone walling" and a refusal to address our concerns or respond to our written request to return all our 200 cellphones and 18 tablets. 

So we then filed a Better Business Bureau complaint on May 02, 2014 and Armando a senior director at Technollo said he would return all our phones and tablets with all their accessories intact including the ones missing at FedEx. However, what happened next was very deceptive and shady. Technollo basically refused to return all our most valuable phones and tablets claiming that they had sold them. Instead they took out the most expensive phones and tablets we had sent to them and said that they had sold it and then returned only some of the less valuable brands without their accessories and without them in the appropriate boxes thus leaving us with no way to test them.

Therefore, we are currently considering pursuing legal action against Technollo and will advice anyone seeking to do business with them to be aware of the fact that they will try to take advantage of you by low balling you on the price once they have your devices with them and if you push back then they will begin a drawn out delay tactics where they say that they are working on it but then do nothing with the hope that you will get frustrated and give up and accept whatever amount they offer as settlement. 

They will also refuse to talk to you on the phone once you express any concerns with them and only reply you with emails that don't address your concerns but talks around it thus frustrating you endlessly.

Update: Contrarily to the above false statements by Technollo regarding FedEx claim: FedEx didn’t refuse to honor the claim because no proof was provided of what was inside the missing box. The truth is that FedEx claims department received our invoice regarding the contents of the box but is only willing to pay a max liability of $100 on the missing box containing 87 of our most expensive phones that was provided to Technollo using their FedEx account number.

This is because Technollo did not purchase the necessary insurance on the declared value of the shipment when they provided us their FedEx account number to ship our phones and tablets to them.  Therefore, legally Technollo is responsible for the balance of the claim as per the invoice and demand for payment submitted by us.

The bottom line is that Technollo has refused to return all our phones in their possession and or compensate us for the phones they clearly acknowledge receiving.

So at this point we have had no choice but to take legal actions against Technollo.  

We are also considering filling a report with the Texas State Attorney General’s office, as well as the Federal Trade Commission among several other government agencies and media outlets that we have contacted to notify them about Technollo’s deceptive and fraudulent trade practice.

Again this is a very deceptive and shady company that will result to all sorts of delay tactics and misinformation to avoid paying us for our phones or simply returning them to us.

Missing box claim is invalid as customer never provided any proof of what was actually sent. Very uncooperative when we asked for any type of proof of purchase, serial numbers, model numbers, makes and what type of phones were inside missing box. Fedex gave us same info that customer gave them which was only "87 phones".



Fedex refused to honor any type of claim because no proof was provided of what actually inside the missing box.

 

That claim has not gone to our lawyers who are speaking with customer lawyer.

 

There was no contract signed between us and customer so there is no breach.
