I lived at The Preserve for 3 years. Paid rent on time, never caused problems, and followed the rules. Recently gave my written notice to vacate the premises upon lease term at the end of February 2014. Unfortunately my father had passed, I had been out of town, and had forgotten about it. I was quickly reminded of why I wanted to move when I got back and had to call for sewage backing up again. I gave written notice on February 11th. Generally they sent reminders your lease was coming due, but apparently they didn't feel the need to do so, therefore I was a little late. Yes my fault, but stuff happens.
Now they knew very well there were many maintenance issues in my apartment, anything from leaks, mold, electrical, to the extreme of sewage backing up into my only bathroom causing the toilet to overflow and sewage would come up into the tub/shower as well; sometimes while I was in it. (no I never bathed, only showered). The last few months I was there the sewage backing up became a regular problem. I wouldn't be able to have use of my shower or toilet for many hours. Did they care, no, and the maintenance let you know what a nuisance you were. I have a paper trail of the maintenance issues, so you would think they would realize these problems needed to be fixed. They were fully aware but chose not to do the repairs. It actually got to the point they would no longer call a plumber directly out. They instead had maintenance inspect if before calling; making a longer wait time to have use of the bathroom (1 bedroom / 1 bath).
So as you can see, I could no longer live there. They told me they would accept my notice, even though a little late, as my full 30 days, due to the living situation. I even provided pictures and offered more and video if they needed it. Of course they lied. I had to call to find out where my deposit was, and the assistant manager said she said she sent a letter to my previous address; even though I gave her may new address on March 1st when I handed her my keys. The chick even congratulated my moving to such an awesome area and told me I really should get a bike; I would love it. This is the same girl who told me if I didn't like it I would have to contact corporate. Fortunately the previous address I used was my daughters, so I picked up the letter.
They kept my $200 deposit, and want an additional $49 for not fulfilling my 30 day notice (through March 11th); also charging for water while I was not there as well. This shouldn't be allowed. For God's sake, I was living in a biohazard. So I've been told it's a pointless battle over such little money, and I should just pay what they want so it doesn't end up costing me more.
What really ticks me off is that slumlords continue to get away with this. And no they never fixed the sewage issue. They immediately rented my old apartment, and the unsuspecting youg man, from what I was told by my previous neighbor who is still there, has already experienced the sewage problems several times (it hasn't even been 2 months yet). Yes my previous neighbor is still there, she is elderly, on a fixed income, has no transportation, and no option to move. Imagine being in her shoes and not having access to your toilet for hours on end.
All I want is my deposit back. I even paid to have the carpets cleaned, and left everything better than it was when I moved in. I have always gotten my deposit returned, and have never had to live in these conditions. You would think they would have to return my deposit under the circumstances, but apparently not.
Instead of my $200 deposit returned, I've been left with PTSS (Post Traumatic Sewage Syndrome). Yes, I still am leary of flushing my toilet in my new place, or wherever I go, and I always look down in the shower to be sure nothing is backing up. I'm pretty sure I won't ever bath again.
