Michael, I am very sorry to hear that you sister has lost her house. As I cannot ascertain her name from you letter, I can neither confirm nor deny the accuracy of your statements. What I can say is that we offer a money back guarantee in the event that we are unable to prevent a client from loosing their home to foreclosure. I would very much like to hear from her so that we can initiate the refund process. The sad fact of the matter is that no modification company can guarantee that 100% of it's clients will get a fantastic modification. Every situation is different and fraught with danger, because at the end of the day, we're convincing a bank that someone who has defaulted on their mortgage deserves to get a lower payment. We do have an exceptionally high rate of success; well over 90%. Unfortunately, there are just some situations that cannot be saved, and to guarantee a 100% rate of success would be foolish. Everyone knows that some situations just cannot be saved, that's why we offer a refund to our clients in the event that we are unable to help. Lets also not forget that the singular reason that someone would fall into foreclosure is that they are unable to maintain their mortgage payments. Now this may be the result of any number of factors and the economy that we've been dealt these past 18 months has certainly not helped, but the fact remains that if those payments were made there would have been no foreclosure. My company acts as an advocate for those who have fallen on hard times. We convince their lenders that they would be better served to lower the homeowners monthly payments than to foreclose on the home. This is no small task, and requires many man hours of work to complete a successful modification. In the month of May alone, we saved 116 families and homes from foreclosure, and as I've previously stated we have a very high rate of success. It is impossible in any business transaction to guarantee a 100% rate of success. No attorney can or will guarantee a 'not guilty' verdict, no doctor can guarantee that he'll cure 100% of his patients, and no financial advisor can guarantee a positive rate of return 100% of the time. Likewise, my company cannot guarantee that every single client that comes to us will receive a loan modification. What we do guarantee, quite generously, is that if we are unable to prevent foreclosure, then that client is eligible for a refund. Even though a lot of our time and money is spent, I don't want my company to be in the business of keeping peoples' money that we could not help. Now as I've mentioned before I cannot speak to your sister's situation in particular without knowing her name, but what I can say is that if she did loose her home, then I'd certainly be willing to stand behind our guarantee and review her file for a refund. Kindest Regards, David Bouffard CEO Truman Foreclosure Assistance
