Hi. Wachovia Bank Ripped Me Off and I am HOT HOT HOT

I deposited cash in my bank to cover all the credit card purchases that were to go through and I checked everday when I got I home to make sure it posted and there was money in the account to cover the bills before I paid them.

However, Wachovia bank put hold on funds but never took out of account or showed any holds, and then put them all through at the same time after they took out their fees first so they took out the NSF fees before they put the bills through and that made me have no money because they took out their fees first and then put the payments through and then charged me twice for insuffience funds.

The last thing showing on my account was I had $110 in my bank on 10/18 to cover bills and they took out $90 when it clearly showed I had funds in there and that made me have like $10 and the on 10/19 they put the bills through which of course there was no money to cover, they already took it out for NSF the day before they even put the bill through, like three or four bills were no good after they took the first $90 out and then they charged me $30 again.

What a complete rip off. I know for a fact the money was there. I put the cash in the bank to make sure it was there before I paid the bill, went to bank deposited cash went home checked computer to make sure it cleared and then went on line and pay my bill, I went right to the computer after the deposit to check that it cleared wondering why the other money had not gone through but still with enough to cover my bills and then I went and paid them and then they totally ripped me off.

This is totally a scam and I want a class action suit against them I am sure they are totally ripping people off, no doubt in my mind. I am not wrong I know I had the money there they took it and then made my bills bounce. They hung up the phone on me just like the other rip off compliant I read I called back three times but they all want to explain it and I said there is nothing to explain you took my money before the bills were paid and made them bad and then gave me a double whammie and charged me twice for nonsufficient funds, because the took my money before covering the bills. The cash was there and no one is going to tell me different.

Luckily for them it is Friday and they are not open tomorrow because I am going down to the local bank here and see the manager and all hell is going to break loose. I am closing that account and I will tell everyone and anyone not to go there. They hold your checks and put them all through the same day after they see you might be over a few cents and then they take out their NSF fees before they put the money through and they are the ones taking the money and making you have insuffient funds before the bills clear.

We need to stop this and make them pay for the stress and aggrivation this is causing undoubtly people who are just barely getting by as it is. All I Can Say, Please tell me how to start a CLASS ACTION LAW SUIT. I need someone to take this case of rip-off fraud today.

Hi, Thank you both for the information and your responses...I guess I was a bit upset at first and now I am over it other things to worry about now, would you believe we had a hurricaine Whilma here last Monday when I wanted to go to the bank and take care of this and it was a category 3, a real disaster, you never saw so many trees in your life ripped out of the ground. We got lucky only 5 days of no electric just came on yesterday.. but other places all over have none..the lines for gas are extremely long and they limited how much you can get...all resturants are out of food because so many people without electric. You don't realize the distruction until you open your door and look out and see every window broken all the cars with broken windows some with huge trees fallen on them and this goes on on for over 100 miles in all directions and then some... Send some trucks down to get the trees for firewood and bring it back up north, you never saw so many in your life piles and piles all over the streets ripped out of the ground like dominos. They are mulching it up in a couple places but it is going to take a long time to remove all these trees, thousands of them every street in every direction..They haven't even started to remove them yet just cutting the ones down on peoples homes and they are piled mile high on every corner all down the streets. I never saw anything like it in my life.. We faired well here no broken windows or damage but every other townhome here had every window blown out..the trees took the sidewalk up with it and you could see all the roots huge gigantic trees and this is for miles and miles..places that you could not see are now open it was instant removal of all the hidden places..lots of roofs blown off but mostly the shingle ones, the S-tile barrel roofs faired pretty well missing a few here and there but I must say the newer ones did well in the storm, I would not want to be here for a 4 or 5 say goodbye to your house no matter what the structure...most screened in pools were completely blown away all the signs on the highway gone, the advertisment ones and every street light broken, most barely hanging and dangling to the ground or blown away. Every corner is a 4 way stop no lights only maybe one or two along the way that are working...the storm does not descriminate big or little houses everyone got damage one way or another... It looks like your world was just blown away overnight..I don't know how long it will take to fix this and it seems like only half the destruction of Katrina at least structures are still standing but that is just in our neighborhood this goes on for 100s of miles..not sure what Naples and the Florida Keys looks like haven't seen much footage on the news we are exactly across from Naples 1.5 hours in the middle of the state west of Fort Lauderdale, the eye of the hurricane was 85 miles wide.... I can't imagine if we had flooding with this but they did and that is even worse.. So now my bank problem seems like the last important thing on my mind...the banks down here don't even have electric yet..we got lucky on the same street as Fire Department and Police and Hospital down the street..others may have to wait up to 4 weeks until electric is restored..Went up north to my sisters in Melbourne 2.5 hours north of here and they even got hit by the storm with broken windows and only lost electric for a short time however they have gas and it was only $2.59 compared to the $2.79 down here....Until they just started getting electric turned on there was no gas anywhere down here you had to have a gas can to get some and you couldn't buy or find a gas can if you wanted to... This is called live and learn..Fill up the gas tank and buy about 5 more gas cans so you have enough gas to get out of town..all the way up to Fort Pierce people broken down on the side of road with no gas and no place to go even if you have money to get some..at the toll plaza it was a 3-4 hour wait to get gas and then they had signs there was no gas and ran out...a true disaster for sure... You are never prepared enough for this and lots of people with generators who can't even get gas to run them either...you definitely have to have been in a storm like this to know what to do next time...not enough food, batteries for flashlight and radio and don't forget charcoal or gas for grilling food, of course the food does not stay good long enough after your frig has no electric, had to throw all our frozen food away and everything in it because we never bought any stuff for grilling, but we went up to my sisters so we were lucky....just a bit of info on the bare necessities of life...you don't know what you got until it's gone.. Well, I will be heading to the bank when it opens and will let you know how I fair with them...hopefully they refund the money, I sure could use it after a week without electric to work on the computer, luckly I work at home as a medical transcriptionist, so my job is still here however, many still with no power cannot go back to work yet.....In the meantime, just getting back to reality though it seems like it will be a long time coming we were one of the lucky ones here...it is just a disaster no other way to explain it...Anyone that can help to get these trees would be great... there are thousands that need to be removed and looks like enough firewood to heat the whole northern US....... The transaction on your statement marked COM means COMMENT, and it is the merchant placing a hold (a pre-auth) on your account for an electronic transaction. It is common that the pre-auth and the actual transaction come in a day apart. I couldn't really follow your statement here, but what often happens is that a merchant puts through a hold for one amount, then a transaction for a different amount, or with a different merchant number. When your bank processes this transaction, it doesn't exactly match anything being held, so that held amount does not immediately drop off your account. This can, in fact, cause you to be overdrawn. If this is the case, I would calmly explain to the bank that you were never actaully overdrawn, they should relent. Ask them to show you what was held, and when the hold was dropped.

First, I did not say you were "ingorant". Second, I do not work for any bank or finacial institution. Third, I was in the middle of editing my comment, was interupted and forgot to go back and finish my edits. What I intended to say was that I took a quick scan of your bank's terms and conditions and there is a section concering law suits and disbutes with the bank. It might be a good idea to simply review it so that you have an idea of what your rights are. I apologize for not correcting that part before submitting my response. Forth, I am not saying in is your fault nor am I saying it's the banks fault. If you have all your receipts and documents to back up your claim of unwarrented fees and the bank does not refund them, then you are being ripped off. If your initial report and subsequent response are any indication, your "civlized" discussions don't seem to be working. You may want to try another tack. Good luck and I do hope that you can get the results you're looking for.

Hi, I will go in there calm and collected and state my case and close the account anyway..there are many other banks who want the business... but not sure what you mean by I gave up my right when opened the account..There are been numerous class action suits for instance Barrett Bank and Provindian had similar cases such as this and had to pay back the money because my mother got money back and never even applied for it..so the state found illegal pratices, illegal transactions of taking money out of overdrafts...This is clearly the case. If I go there and find this to be the true case, I am going to the news stations, like Help Me Howard and Investigations... I had the cash there it showed it was there before they took out the unavailable funds fee..and that is the reason the other cable bill and E.bay fee did not have the funds avialable...they took it, plain and simple... This is how it looks on line....re PP is a bill or deduction.. 10/13 deposit $20 balance $48.33 10/17 deposit $200 balance $248.33 10/18 PP $85.99 balance $162.34 10/18 PP $45.41 balance $116.93 10/18 PP $4.49 balance $112.42 10/18 PP $1.29 balance $111.15 10/18 Unavialable funds $90 balance $21.15 LOOK 10/19 Deposit $10.00 balance $31.15 10/19 Cable $48.33 com 10/18 balance -$17.18 only bill that went through 10/18 plenty of money with the 111.15 balance but not available because they took the money with the unavailable funds charge... 10/19 Overlimit fee $30 balance -$47.18 10/20 PP $69.03 com 10/19 balance -$116.21 I guess the com- stands for completed and this went through on the 19th after $10 was put in to cover the amount I would have been short after the cable bill was paid....I should have had like $4 over after those two bills were paid.. 10/20 Overlimit fee $30 balance -$146.21 Figure this on 10/18 I had 111.15 the only bill that should have went though was the cable bill..of 48.33 I had the funds there and the balance should have been 62.82... Then on the 19th, I deposited $10, for some reason I think that was on the 18th but need to check my bill with e.bay...anyway it would not have mattered as I put the cash in and then paid the bill so it should have been there.. I never pay the bill until after I put the cash in the bank and verify that it on my online balance statement which it has always shown up right after I put it in, I just live down the street from the bank and I deposit cash and come home and pay the bill... Anyway after the $10 would have been added to the balance which I should have had of 62.82 my new balance should have been 72.82 the e.bay fees were only $69.03 and that should have left a balance of $3.79 which is exactly what I thought I had, now I went to pay another bill and deposited $20 in the account went home to check it yesterday 10/21 and found that I was $146.00 overdrawn, of course that is now $20 less than that, and I have lost the money to the bank that I really needed to pay another bill yesterday... This is complete fraudulent activity and I am going to get it in black and white when I print out the statement today...There has to be some protection for consumers of this fraud... In response to the response I received it sounds to be me like you work for the bank...this is totally fraudulent activity, it would not matter what order they put those last two bills in there was enough money to cover either one at that point it shows the $111.15 before they took out their fraudulent $90 and it would not matter which bill was put in first the cable 48.33 or the e.bay fees of 69.03. There was enough money to cover either one no matter what the order... I paid the cable on the 17th it apparently never was completed until the 18th if that is what the COM on the statement stands for...so the money was there for that... I am going to check the day I paid e.bay this is where I think they are fraudulent..I thought I paid e.bay on the 18th and that is the day I deposited the $10 cash but they have the deposit on the 19th..and on statement date for e.bay fees is 10/20 com 10/19 assuming again com stands for completed.....but lets say it was $10 short just for the sake of it that would only make one unavilable funds no matter how you look at it..but I know for a fact that I deposited the extra $10 cash before I paid the bill...cash is suppose to be instantly avialable after deposit..and the reason the funds were there is obvious they took out their unavailable $90 fee before putting through the bills... I am going to investigate this and have the news investigate it after I go to the bank and see what they have for an excuse...no matter, I am closing the account regardless...Signing off-RIPOFF FRAUD.. They are messing with peoples hard earned money and intelleigence....I am not ingorant, I know my money to the pennny....Not only this before I even posted this RIP OFF response, I read several others that had the exact same thing happen to them and the service center has the nerve to hang up the phone on you, obviously they are playing with our intelligence and thats what makes me the Hottest and yes I will vent it out but of course in a civlized way, I will take this to the local news to investigate if I have too, they are always looking for a good story and I believe this is a the rip off scams of all scams, they can pay there own overdraft over the limit fees, I will not, as as for my credit is concerned....take a number.....I will have another bank by Monday....

DO NOT go down to your local branch with the intention of causing a scene. You will get nowhere and possible get kicked out of the bank. Gather your receipt from your cash deposit, print out you account register and bring along your copy of your account's terms and conditions so that you can reference the bank's funds availablity section. Present your arguement calmly. Give the bank representative an oppertunity to review your account and explain anything they may disagree with. Use your paperwork to bolster your argument. If you still feel that the bank is wrong then close your account. Do not go into the bank breathing fire and threatening law suits. You will get absolutly nowhere. Forget about a class action. Your terms and conditions state that by opening an account you waived that right. Good luck.
