Our payment arrived one day late and when we got our statement they had charged us a $39.00 late fee. We immediately called customer service to request that they remove the fee. The agent said since we had been good customers he could remove the fee one time per year. When we sent our next payment we deducted the late fee from the minimum payment because they had waived it. We sent our payment of $35.00 which arrived on time.

Toward the end of that month they started calling us about owing the $39 late fee and then said we owed them $108.00. We explained the situation to a customer service agent in collections without any help. We then explained the problem to a supervisor who hung up on us. We noticed that they were calling 5-6 times a day, even after we spoke to them. We asked and then sent (faxed at their request) a letter to STOP calling. They continue to call and harass us and make fun of us for not paying a payment that was supposed to be waived. When I tell them we sent a letter to stop calling they say they have not received it. They say they took the amount off our balance not off the payment so we still owe them. They have also pressed us to post date a check up to 14 days in advance.

The last time I read the law that was against the law. I have pointed all the facts out to the representatives and also managers and they still continue to call, harass, hang up and be obnoxious. We filed a complaint with the FTC as well, reported this to the BBB and now we're on a mission to sue them...

Not sure why there is a "ripoff" here. YOU decided you would deduct the "late fee". How could you be sending a payment in if that payment it would be a negative amount? ($35 payment-$39late fee) they would owe you $4. ANYWAY, what you did is NOT procedurally correct they remove it from your balance NOT your payment amount. It was YOUR error because in sending the revised amount its considered a partial payment and your monthly obligation is not satisfied. While they may not be handling the situation professionally they have done nothing wrong and being primary creditor they are able to contact you by any means to get THEIR money.
