The following testimony is completely factual and not intended to slander or falsely accuse anyone. Many people and their families are being impacted by this company.

Basically I'm an independent contractor using my own vehicle, gas, etc. and I contracted with ACE Logistics. I answered an ad they had posted on Craigslist. Upon signing my contract, I was handed a remittance sheet by the Operations Mgr. (Tim Nyland) as to when I could expect payment for the deliveries I complete for ACE. I was to be paid 50% commission. When it came time to receive my first full payroll settlement, they were unable to follow through and only paid me roughly 1/4 of what they owed. The same thing happened the following payday and the owner, Ed Skurat, had a conference call. ACE employs over 300 drivers in 5 states and they told all of us that we would be payed but the company was having issues. He forwarded a document to all the drivers stating his intentions. Unfortunately, my next check was $21 and I was owed around $1600 for that period. In fact, most drivers were paid a similar amount($50) that period as well.

As it turns out, Tim Nyland apparently knew they had serious cash flow & payroll issues when he hired me in early June- but failed to disclose that. I have over 25 years experience and told him I could go back to one of the other companies I had worked for if he didn't have enough volume for me. I told him I had lost my own business, cargo van and federal authority and had very little money at my disposal and needed work now. He insisted he had work and I trusted him and now I'm in a terrible position as a result.

That $21 check was the beginning of the end for my family. Shortly thereafter, I had to park my car and give up my assigned US Bank routes as I simply ran out of fuel money to keep the wheels rolling. I did receive two partial checks ($500 or less) in the past month that didn't even make my house and car payments. I'm owed in excess of $2500 (and up to $3000) and that doesn't include the 16 days (I made approx. $170 per day) they strung me along before I resigned last Thursday. They repeatedly told me I could expect payment soon including the past two Fridays; I got nothing but lies. Apparently, many of the drivers are not being paid at this time and the company has resorted to paying selective drivers who can still afford fuel money which of course continues to bring in money for ACE as well. They do, however, continue to rent large trucks from Budget and steal from the drivers by using money owed to us to keep their own butts afloat. Meanwhile, I had to pawn my wedding band for $100 the day I resigned to feed my family. A woman who works on the dock at US Bank operations where ACE has an office had to hock her wedding ring and she's married to the son of the owner's wife. We also applied for emergency food stamps. We're behind in almost every bill we have because of this company.

I did consult an attorney and some drivers who are in the same position as myself. We're trying to move forward and merely get what is owed to us. Last week they let a woman go who worked in the office and I saw a stack of unpaid vendor and misc. bills that I was told was higher than at any time in recent years. I'm afraid ACE is going to go out of business or file bankruptcy and screw all of us.

All I did was work from 7am until 10pm everyday for these people. I never turned down a single run and always represented the company in a professional manner. I was more than kind and patient with them until they began to lie and blow me off. I do have bills of lading and route receipts to substantiate my allegations.

ACE has lost their US Bank routes and apparently the great majority of their business and drivers. Barring a miracle, ACE has all but ceased operations. At this point, the only hope of recovering anything from ACE would be to file a lawsuit and attach a lien on whatever company property remains. However, most(if not all) attorneys very likely would not be even remotely interested in investing the time and effort of their law firm if the only pot at the end of the rainbow is the older delivery trucks and vans at ACE.

It appears that it's time to just move on and use our energies in a more positive way. Yes most of us are in a bad position because of ACE; I'm out $3Kmyself. And yes it was incredibly frustrating getting blown off and lied too the past couple month's. However, now that the situation has unfolded and I've finally been able to hear all sides and make a conscious evaluation of the matters at hand, I've concluded that ACE's demise can be traced to many factors- but blatant intentional fleecing of the drivers and their families doesn't appear to be one of them. And even if some money and/or situations were handled inappropriately, I'm confident these things take care of themselves as none of us get away with anything in the end.

Had anybody at ACE just been as honest with me as they have in the aftermath of all this, then things like ripoff report may not have been necessary. But then again, I'm not sure I would've been able to look every single driver in the eye and tell them their ship is sinking either.
