The Reno jury in the Melinda Ellis case that found Alessi Koenig liable for civil racketeering was wrong. It's that simple. AK's client in the case is one of the largest HOAs in Reno and their HOA manager is one of the most experienced and well respected in the industry. Both the HOA client and the HOA manager continued to use Alessi Koenig's services long after the erroneous jury verdict. This would not have been the case if there was any merit to the jury decision. The property at issue in the case wasn't even foreclosed upon. Courts and juries are imperfect.

This rip off report complaint is likely generated by an upset homeowner who fell behind in their HOA assessments and did not like the consequences of becoming delinquent. While being upset is understandable, it does not excuse the defamatory comments and spreading of half truths by this author.

David Alessi has been a California licensed attorney for nearly 15 years and has no record of discipline from the State Bar. If the allegations made in this complaint were true his license would have been suspended or taken long ago.
In his testimony to an HOA regulatory agency, David Alessi also advocated for a REDUCTION in HOA collection fees and costs. In fact, Alessi Koenig was the only assessment collection firm in the industry to do so, despite it being against the firm's financial interest.
A property is foreclosed upon only after the delinquent owner receives several written warnings, most of which are sent regular and certified mail. Foreclosure sales are conducted at public auctions. The process is heavily monitored and regulated.
Of course payment plans are allowed by the HOA and often entered into by the delinquent homeowner. In fact, payment plans are encouraged by the board as foreclosure is always a last option.
