I won an auction for $7.70 that I found out later wasn't really a legitimate auction. I first thought this was a charity for some sort of organization but after winning it I reread and it was for her family. I posted a thread on eBay asking if this was legit. and a poster said "No." I contacted her about this and she excused me for the transaction. This all took place on October 25th.
On November 13th, I left neutral feedback stating calmly "Charities for yourself are not legitimate items to sell on eBay. Do not buy! C-!" and that was true to the word. Yesterday on Nov. 22nd, she sent a Feedback Revision request (no other communication) and threatened to report me to eBay if I didn't revise the feedback. Usually I try to work things out with sellers if problems arise beforehand but there was no working with her. So I simply declined and told her to leave me alone. Which she didn't.
She then proceeded to file a UPI dispute which was a mistake that I even paid the tramp. I just didn't want a strike on my record. I told her I wanted my money back because she wasn't selling a legitimate item. She sent me a reply back stating she would not refund me. I then contacted eBay customer support and spoke with a specialist who looked into this very auction and told me this was not allowed on eBay and that if I opened a case, I would get my money back.
As a last email I told that seller I was filing reports for this and she once again was vindictive and threatened to report me to eBay. I'm finding that a large number (not all) of eBay sellers are scummy people who have nothing better to do but to take your money and either be uncooperative or nasty in nature. This is certainly one of them! Watch out for this one!

It has been a long time since this but I reread what we wrote and it seems like a show on Jerry Springer. This woman is now suspended on eBay (has been for a couple of years) and even though she admits that nothing happened to her, it still doesn't hold water if you look at the facts. The fact is that there is a policy on eBay that doesn't allow people to raise money for themselves or their family - it HAS to be a legitimate cause. She DID NOT get consent from the Secretary Of State to acquire tax exemption status. It was reported way back then but unfort. nothing came out of it. The eBay rep. emails back then were generic and only knew so much - now they only accept phone communication. Charging people for not selling a physical item such as that is not only wrong, it's criminal. She also got another piece of this wrong...I am not an old man - the man calling her was my grandfather because he was trying to help but he did not make threats. There was no "sister" - it was me (she doesn't have the story straight). I did overstep the boundaries a little bit and for that I apologize. I do not enjoy fighting either but this person really got my nerves and didn't handle it very professionally. Case closed.

I WOULD JUST LIKE YOU TO KNOW THAT NOTHING EVER HAPPENED. EBAY SAYS I DID NOTHING WRONG. IF THE FBI WAS NOTIFIED THEY DID NOTHING ABOUT THIS. IF BBB WAS NOTIFIED THEY DID NOTHING ABOUT THIS. IF EBAY WAS NOTIFIED THEY DID NOTHING ABOUT THIS. IT JUST GOES TO SHOW THAT I DID NOTHING WRONG AND THE FACT THAT I DID NOT GET IN ANY SORT OF TROUBLE FOR IT SHOWS THAT I WAS IN THE RIGHT. I ALSO HAD A VERY LONG CONVERSATION WITH AN EBAY REPRESENTITIVE AND THEY TOLD ME THAT THE WAY I WAS GOING ABOUT THE LISTINGS WAS NOT AGAINST POLICY BECAUSE I CLEARLY STATE IN MY LISTINGS THAT THIS IS FOR MY FAMILY AND NOT ANY SORT OF ITEM. I DID NOT FALSIFY ANYTHING AND WHEN THIS MAN BID ON THE ITEM HE COULD CLEARLY SEE WHAT IT WAS FOR BUT WANTED TO LEAVE BAD FEEDBACK AND START SOMETHING. SADLY THERE ARE PEOPLE OUT THERE LIKE THIS THAT JUST ENJOY FIGHTING.

I'm sorry that it went that far but she harassed me too at the same time. I would appreciate if no one replied to this report anymore. I'm moving on.

This man just can not get over himself. Since I asked for him not to contact me anymore he had his (sounded like) 80 year old sister call me at 3 in the morning and she said "F*** YOU AND YOUR HUSBAND."(she said more than that but that was the worst part). You can say that to me all you want but you should not insult the person who risks his life to save yours. Anyways. I went to my local authorities (with all emails and voicemails in hand) to see what legal steps I could take to stop the harassment. The officer said that, not only could I file harassment charges against him and his sister, I could also file assault charges against him for making threats of violence. I told him that I didn't want to file charges if I didn't have to but it was coming to the point were I might need to. He told me that if I didn't want to I didn't have to but if it happens again I should contact their local police department immediately to inform them of the situation and file charges for assault, harassment, and to get a restraining order against both of them. Oh, I can also file charges against his sister for committing a hate crime against my husband because she worded her voicemail in a way that sounds like shes saying f**k you because you're a us soldier and that is discriminating against him and his personal preferences.

There is good news. The seller finally got so sick of this that she refunded me the other day. She was the worst ebay seller I've ever had. Glad it's over. She blocked me from bidding on her auctions but I don't care. I wouldn't do business with her if she was the last person on Earth. Thanks to the above poster - I filed that report to the FBI about her devious actions.

Depending on how much money she/they (if spouse assisted) collected this could be a federal crime. I would write an official notorized letter to ebay advising them. They can trace the IP address and find out if she has utilized pseudonyms to sell to others and how much she has made. They then will be forced to hand over the information to her local authorities as Ebay is bound to turn over any information surrounding crimes that may have federal implications to authorities.

To register a charity and collect donations one must first obtain consent from their Secretary of State to obtain tax exempt status. Some states require it also to be approved by the dept of labor. Without this status, you are commiting a crime and can face mass penalties including jail time for falsely represnting yourself. Issues will arrise with the FBI and the IRS.
If I were you, I'd report her to the FBI and the state police where she resides (not where you are).
This is illegal gift collecting under false pretense.

That eBay rep is in the dark. She doesn't know that the item wasn't even supposed to be on eBay and asking strangers for money when selling nothing is wrong. And this witch made all that fuss over a stupid neutral feedback that didn't even hurt her score. GET OVER IT!
This woman should be suspended on eBay but unfort. she isn't.

This is the last warning. If there are anymore contacts from you I'm filing a police report. I know a couple police officers personally. I'm blocking all your emails. I don't want a f**king thing from you - don't even bother sending anything because all shipments will be refused from your address. Any emails you send me via ebay will not be replied to and reported. You're a miserable piece of s**t who needs to be kicked off eBay. Off with the sellers head was just an expression but you took it to mean something literally. You are such an awful person that I wonder why you even got married. If anyone went through what I did with you, they would tell you to just go to hell. You go to hell bi*h! Stop sending me emails - you're the one who's harassing me. I told you 3 times to leave me alone. Don't make me file a restraining order. So, go poop in your shitty box and go f*k yourself!
So you can see what a crazy old he is. I know hes old because he called my phone and left a voicemail. Yeah he called to harass me... I could tell by his voice that he is not young.

She's the one that was lying. E-mails went like this:
I said (when auction ended on Oct. 25th):
Could you please cancel this transaction please? My 12 year old son bid when he wasn't supposed to and I didn't know this wasn't a legitimate charity and do not wish to participate.
She said (Day after auction ended):
No I don't believe this was an illegal auction you need to pay what you bid on or I'll be reporting you t0o ebay.
Oct. 27th: (my e-mail):
I am not paying for your illegal charity! It says right here:

You can list items for charity without eBay Giving Works if:
|
Since eBay is a place where people buy all sorts of items, it's important that sellers create listings that offer physical items or services. We don't allow listings that aren't offering anything for sale or those that have intangible items (generally things dont physically exist).
Listings also shouldn't include personal opinions, political views, or offensive comments about eBay members. See the guidelines below for more details on our policy.
Make sure your listing follows our guidelines. If it doesn't, it may be removed, and your buying and selling privileges could be restricted.

I have proof that this customer knew exactly what he was bidding on and only bid to leave bad feedback and then lied and said his 12 year old son bid on it. THIS IS AN OLD MAN. HE DOES NOT HAVE A 12 YEAR OLD. I also have proof of him harassing and threatening me. You will see all of this below.
Dear 541.amanda,
Cancel
this transaction please. My 12 year old son bid on this by mistake. He
is now grounded for a long time. Sorry for any inconvienence.
after this he started to use a different ebay name.
Reason for request: | Other | ||||||||
they
buyer did not pay for anything and it is a personal choice to donate.
if this person does not choose to do so then they should leave it
alone. also falsified who they were and bid on this item just to leave
bad feedback. i will report the buyer to ebay if the feedback is not
revised. Dear 541.amanda, leave me alone please. Dear 541.amanda, And I will be reporting your little charity auction to ebay. I just paid you but I want the money back. If you dare report me to ebay they will take a look at that auction and then you will get in trouble yourself. Do you really want that? You are 20 years old and already have the legal thing you're talking about in your life. What is it with you ebay sellers and legal things? Get a life and leave me alone~! Dear milestone-mania-500, I'm not doing anything to you. I'm doing what I know is right. I didn't deserve the feedback. If you did not agree with us trying to raise a little money you did not have to bid just to leave feedback. You could have just left it alone. I will be reporting it to ebay though. This was against ebay policy and was entirely avoidable and unnecessary. I don't know why you are acting like I'm harassing you anyways. I have made completely legal steps to get the feedback revised and it was my right as an ebay member to do so. I will be taking completely legal steps to report you to ebay. What would you tell the authorities? That I reported you to ebay and requested a feedback revision? he started mailing to my personal email after this You young lady need a lesson in customer service. You are going way off the edge. In fact I recommend professional mental help. I have been on eBay since August 2001 and haven't let anyone bully me into anything. Oh do I wish Judge Judy could take this case - she would really chew you up! This is what's going to happen. I am going to get my money back you money hungry theif! I talked to Angelo from eBay customer support on the phone just now and you know what? He researched the auction and it isn't allowed. In fact he is writing up a report and told me you may have your account sanctioned. Threats will get you nowhere and what I'm telling you now isn't threats because they are things that are going to happen. You will be written up on Ripoffreport.com with all your personal information exposed. Also since this is an intangible item with ebay that isn't allowed, I will get my money back. If anyth9ing goes wrong, then I go through my credit card company. Also, you will be written up with the Better Business Bureau. If that isn't enough for your girly shitty attitude, then the FBI Cyber Crimes Division will be brought into this. So, don't fuss with me lady because I've been through rough times in my life and know how to handle it most of the time. I say enough of this eBay nightmare and off with the eBay seller's heads as they say in Alice In Wonderland!
Report me away stupid Amanda. You're the one who violated ebay policy. The only thing I care about is getting my money back. And with all the s**t I've dealt with from ebay sellers and nasty people the only punishment I could care about is the death penalty. So sue me! Amanda you know what you were doing was wrong. I'm not threatening you. In fact God will punish all those who sin including you. Do not contact me again - you were the one who bothered me first about this. So you see I had every right to report him on every level and was told by ebay, paypal, and AOL that it was the right thing to do. |
