ASC Americas Servicing Company ripoff we paid till 01.01.2006 as soon as my Finance files a bancrupcy they put it in collections saying we have not paid since Oct 2005 Its in the Trusties office and now in collections??? Frederick Maryland
We were current on our mortgage payment at the time of a bankrupcy. So that ASC can make 900.00 extra dollars off of us they put the file in collections a few days after the file is in the trusties office awaiting final word from the companies involved. ASC was not at the creditors meeting, by all rights they LOOSE. But they say that we have not paid and throw the file into collections so they can gain ground and call a forclosure??? This is very wrong and we do not owe 900.00 in back payment and we were current the day of the bankrupcy which was 12.20.2005...Ya SNOOZE YA LOOSE should be true here...

Your post doesn't make a lot of sense primarily because of the lack of clarity and detail. If the mortgate company put in you collections and starting charging you late fees in violation of the automatic stay, then you should file a motion for sanctions with the bankruptcy. And I have no idea what you think mean about them not showing up to the Meeting of Creditors. That has nothing to do with whether or not you owe the money or whether or not they can pursue what is owed to them.
