Asset Acceptance Ripoff Fraudulently obtained a default judgment against me Brandon Florida
Several years ago (2001) I received a certified letter from Asset Acceptance LLC. In the envelope, was a certified copy of a Default Judgment and a Writ of Garnishment. Being a Head of Household with minor children, I was able to have the Writ of Garnishment dissolved, and as law illiterate as I am, I also thought the judgment was also taken care of, i.e. dismisssed! When I realized that it kept on being reported on my credit report, still ignorant, I've tried to dispute it, alas! My problem is that I was never notified of any court or pre-trial hearing. I have NEVER before heard of any legal proceedings until I received the copy of the Default Judgment in the mail. Not only have I NEVER BEEN "SERVED", I've also NEVER had any financial dealings with Asset Acceptance. Through all the paperwork there is absolutely no mention of any original creditor, but solely an amount of $ 569.00.
After reading your posts a few days ago, I contacted the courthouse and was told that their computer records shows a docket entry for Affidavit of Proof Of Claim and a docket entry for "service returned" but no supporting evidence on file (they can only tell me that a company was hired for "service"). I requested to view the entire file, and was told to stop by and do so. When I went to the courthouse this morning, it was a totally different story: "...this is a 2001 file and we have to order it for you...we will call you when we receive it..." Before I even made it back home, that same clerk had already called to let me know that the "file has been destroyed since it is over three years old...the only thing we can provide you with is a copy of the Default Judgment and of the Writ to Disssolve Garnishment". Can anyone tell me if this is legit ????
My credit has been adversely affected for the past six years thanks to these jerks, and now all of a sudden all the supportive evidence to substantiate their claim has also vanished. How convenient!
