Received a notice in April 2006 from a company called Asset Acceptance LLC. They state that they have aquired a debt from CitiBank. They claimed the debt amount was $11,744.04. The orginal debt before it was charged off on July 2004 from CitiBank was $8033.10.

I tried to get validation of the debt, and verify the actual amount from the original debtor, and make sure they legitmately own the account. I was not going to send money to someone who says I own them money without any proof!

They then sent a letter stating that I agreed to make payments. I did not agree to anything, and the only thing I wanted was proof that they owned the debt.

Six months later they hired a lawyer. This lawyer filed a civil suit with the court. They stated that they had hired a professional process server to give me the court summons. I never was served, and I didn't hear anything about the suit until after the case was heard, and a default judgement was awarded. The lawyer made d**n sure that I would not be able to respond to the lawsuit in a reasonable manner.

The were eventually awarded $13,417. I then filed a motion to have the default judgment vacated. The main think I want to bring up to the judge is that the debt was never validated. I never owed $11,000 to CitiBank, so where did there figure and interest rate come from.

Asset Acceptance LLC just wanted to find any way to extort money.

I filed a motion to vacate the default judgement. I had significant documentation to support my case. A lawyer assisted me in fighting them in court, and I filed it right away. Less than 30 days since the Default Judgement was handed down. The judge granted my motion. I heard from the prosecution lawyer a month later, and now it appears that Asset Acceptance is no longer using that attorney. I have constantly asked for validation of the debt, and they were never able to ever send anything my way. I am keeping any eye on the courts to make sure they don't try the same thing again. This way if a motion gets filed I am already ready to respond, and they won't be able to fight it. Keep up the fight, and you can win!
