My wife and I were traveling down the road behind a dump truck when a rock the size of a golf ball flew up from the tire cracked my windshield in half. We signaled to the driver to pull over and he just shrugged and kept driving. We got the info off the side of the truck and drove to the business seeking justice. The owner reluctantly admitted being the owner after we asked to see the owner. We described the driver and the truck and he readily identified the driver and even offered an explanation that the particular truck that we were behind had new tires with deep treads and that rocks commonly get stuck in these treads and get flung out from the force of the spinning tire. He said he would contact his insurance agent (he said that his agent was on vacation that week and would be back the week after. I thought it very strange that he knew his agent's vacation schedule so well and figured that he is probably in constant contact with her..LOL) and if his insurance wouldn't cover it, then he would pay for my windshield out of his pocket, stating that it would cost $125.00 installed. Once again, why would he know this off the top of his head? After 2 weeks and no contact from him, I called and he said that he reported it to his insurance company and was waiting for a case (file) number. After a few more days I called him and said he was still waiting. By now I'm very suspicious and I ask him the name of his agent. He tells me and I call her. She states that she has not heard from him and knows nothing of the claim. I call him back and he keeps saying that he called his insurance agent and she should be handling it. The agent finally calls back and tells me that he told her not to file it and that he stated that he is not responsible for my windshield. Long story short, This guy promised me that he would take care of my broken windshield and then had me running around in circles around him and his agent for a week, all the while causing me unnecessary stress because he was not man enough to tell me that he lied to us about his intentions of fixing our broken windshield. This guy is a jerk off, a liar, and a coward. I would never, and would suggest that no one else ever do business with someone of such low character. His name is Rodney Brasswell.

I'm just so sick of this crap why do people want to "HURT" me for.  I haven't done anything but report the wrongs that have been done to me.  This is the "THANKS" i get! nothing but insults & harassment.

Having been a truck driver for over 19 years and having dealt with numerous cracked windshields on my semi truck, I have authority here and will explain the law here.



First it appears per your posting that you were following to closely.  A rock the size of a "golf ball" even after being thrown up off the road would not travel a great distance less you were following closely to the rear of the dump truck.  Meaning if you are closer than 250 feet you are much to close.  The rule of thumb is if you can't see the side mirrors of the truck, then you are much to close and need to back off now.



Secondly, the driver of the dump truck does not have to stop for you ever.  Being that we all live in the post 9/11 era...that driver had no idea who you are or what you were attempting to get him to stop.  He might have thought you were trying to steal his vehicle, his load or worst harm him physically and the driver here choose to ignore you.  If you would have acted in a threating posture, the driver would have every right to remove himself from harm by leaving the roadway, slamming on the brakes to get you to travel away from him or call the local law enforcement agency.  You need to understand that if you try to stop a commercial vehicle and the driver feels threatened, its called hijacking or attempting hijacking.  This is a felony.  Something that you should never try...in this case getting the trucking information off the vehicle is the only way you ever handle this situation and then call the local law enforcement agency and allow them to deal with the situation.



Thirdly, the owner of the company did what anyone in the industry will do period.  Vehicle insurance very rarely covers windshield damage alone since its classified as either following to closely or an act of GOD.  Meaning if another car coming from the other direction kicks up a rock as you are passing them and that rock damages your windshield...there is nothing that either party could have done to prevent it.  Its classified as a non-preventable accident and that is why you have glass coverage on your insurance policy.  No one here is liable period.



Fourthly, the owner follows an established unwritten rule in trucking and insurance companies suggest this all the time.  Do not report minor accidents but instead fix it yourself or pay the claim directly.  This keeps your premiums as low as possible plus the normal deductable for truck insurance is $10,000.  So a $150 windshield claim is both a waste of the insurance agent's time, the insurance company's time and threats the premium costs which in the long run is pasted onto the general customers freight bill.



The owner of the company should have told you that he will not pay for your windshield since that is covered under your own insurance policy.  I do not know the law in Alabama but I can image that their is a no-fault statue on debrie that is kicked up off the road and damages someone else's vehicle. 



The owner could be nice and agree to pay for your windshield too...but per the law he would have no been forced to do so.  If you would have attempted to file a police report, they would have told you that they are unable to do anything since you took to long to contact them. 



If the driver failed to secure his load and rocks were falling out of his dump truck onto the roadway then this whole situation would have had a different outcome.  While you still can not take it into your own hands to stop the dump truck you could have motioned to him that he was losing his load and allowed him to decide what action he wished to do.  Then you have a legal right to call the local law enforcement to either have the vehicle stopped or atleast filed for damages to your vehicle. 



My suggestion then would be to drop back farther and follow the truck till law enforcement was able to stop the dump truck.  Then report to the officer and file a police report for damage to your windshield and then force the owner of the company to pay for the damaged windshield.  This would be called negligence and failure to secure the load which create damage to your vehicle.



BUT, you didnt state that so you are lucky that you saw a dime from this owner.  If I was the owner I would have told you the law and then asked you to leave.  If you would have filed a small claims action against my company I would have pointed out that you clearly were following to close and that this is an act of GOD and is non-preventable.  That you need to file a claim with your insurance carrier for replacement of your windshield.

Well, I decided to file a law suit so on the way to the police station I figured I would give it one last chance that this guy would come to his senses and as a courtesey stopped by the business to ask one last time if he was going to pay for my windshield. Of course, he acted like a complete ignorant a*s and after a short screaming match and calling him a liar and a thief in front of 2 of his employees, he finally called a glass company and told them I was coming. I told him that I hated that we had to go through all this but all I wanted was my windshield fixed. I still would never do business with some one like this.

While I feel your pain, no one likes to spend money on unneeded repairs, I don't see how you can hold the trucking company in question responsible. Too bad, maybe you were driving too close, maybe not, but the driver of said vehicle could hardly predict that he may kick up a rock and it would hit the vehicle behind him. I can't believe you actually drove to the company. If that had been my business I would have shown you the door. I don't see how there is ANY liability on the part of the company. I guess you are a bit upset about the way the owner handled it, and I do understand that. He should have just been honest and told you to get lost. Turn it into your own insurance. Some things just happen, there is not always someone at fault. Next time, keep some distance.
