Business Office System & Solutions - BOSS - Viatel - Voicenet ripoff, fraud, credit report, collection agency, responding, filing a complaint. How to get rid of the problem! Midland Texas
I have had the same experience as the other posters. BOSS claims to have sent collection notices etc to me but I never received any correspondence whatsoever, and in fact never heard of BOSS until their name appeared on my Credit Report.
I disputed the negative info on my credit report but the Credit Agency verified the negative info and indicated the info would remain. I subsequently contacted BOSS and after speaking to Jacob the Supervisor who was nasty, accusatory, and argumentative, proceeded to file complaints with:
The FTC at https://rn.ftc.gov/pls/dod/wsolcq$.startup?Z_ORG_CODE=PU01;
American Collector's Association of Texas at
http://www.texascollectors.com/page3.html;
My state Attorney General's Office, which I found by searching the web;
The Texas Attorney General's Office at http://www.oag.state.tx.us/consumer/complain.shtml;
the Better Business Bureau at http://www.permianbasinbbb.org;
The Federal Communications Commission at http://www.fcc.gov/cgb/complaints.html; and
the United States Postal Service Inspector General at www.uspsoig.gov/hotline_NewCompForm.htm.
I also reviewed the Fair Debt Collection Act (FDCA), which can be found at http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm, and noted that section 809 titled "Validation of Debts" expressly sets forth the protocol a collection agency is supposed to follow regarding debt collection notices/efforts, etc. and your rights as the recipient of such notices.
In light of this information, I sent a letter via certified mail return receipt requested to BOSS stating that although I had contacted BOSS on x date and although I had not received a formal notice that complied with the FDCA, I denied owing any of the monies alleged to be due.
I also made sure to identify all of the sections of the FDCA I beleive BOSS violated via their collection efforts in all of the complaints I filed. I also referred all of those agencies to the postings contained on this board! At the time I dealt with BOSS there were substantially less complaints!
I strongly urge everyone out there who has been wronged to file complaints with any and all possible government agencies including but not limited to at least those agencies set forth above.
In the end, BOSS discharged the monies owed and supposedly removed the negative info from my credit report (I have not yet ordered a report to confirm as I am waiting for the free credit report act to go into effect in my state).
