23 people in the Tampa Bay area with unfinished pools and unpaid contractor liens courtesy of Capital Pools and Spas. Greg Luce-the Capital Fool who knowingly made promises of all shapes and sizes, all the while STEALING OUR MONEY knowing full well he had no intentions of completing the work or paying the contractors. Bill (Arthur) Wilson-the smiling "don't blame me" salesman who continues to try to upsell additional services-all the while knowing Greg Luce's intentions while playing the role of "good cop" to Greg's "bad cop". Very interesting that Bill knows exactly what is going on with Greg on a daily basis but claims to be trying to distance himself from the company. Jarrell (Jerry) Marcum-the on site supervisor who continues to try and collect checks while having full knowledge of Capital Pool's situation and Greg Luce's intentions. This genius Jerry has been going to peoples homes with the list of 23 people with unfinished business, offering to quote the remaining work and complete it for a price. Let me get this straight-we make our FIRST payment to Capital Pools for materials and construction services, then we have to make the same payment a SECOND time to the unpaid contractors (let us remember that the contractors involved here are victims just as we are) who have also been ripped off by Greg and his merry band of scam artists, and now we are being asked to make that same payment a THIRD time by Greg's foreman/supervisor who is now going to "save the day" and rescue us from this horrible experience by ripping us off again. ENOUGH! 23 people are extremely fed up and want these criminals PUT IN JAIL for the crime of KNOWINGLY COMMITING FRAUD! I wonder if the $$ amount plus the numerous unfulfilled contracts will make this a felony? I have to think that these individuals have some amount of personal property and posessions that could be liquidated to help pay us back. I know that KFLA News has been contacting some of us to help expose this mess. I am also aware of legal representation being retained for the inevitable breach of contact claim(s) and related costs. DO NOT LET THESE CRIMINALS GET AWAY WITH THIS! I am mad as hell-and I am not going to take it anymore!

Interesting dialogue. I won't get into a "back and forth"-I'll share facts as they have come to me. I have no way of knowing what information Capital Pools shared with who and what they held back. Since my name is being thrown in the mix I'll tell you what I know. I received a phone message on 6/19/08 from Greg Luce stating that Carl and the boy would be here the following day to install the heat pump and collect the final payment. At this point in time I had already received 4 liens notices. Someone affiliated with Capital Pools warned me to ask for lien release letters before taking delivery of the heat pump and making the final payment. Greg never contacted me again after that. I was able to reach him by phone the following week-he told me that Cathy was still working on obtaining the lien releases. I never heard any more on the subject and Capital Pool shut down shortly after that. I never asked for anything free. I always made my payments promptly. The $2344.55 was our last scheduled payment based on Heat Pump delivery and install. Greg agreed to back out $150 for the landscaping crew that cleaned out a section of our yard around the pool area. This left a payment scheduled for $2194.55. The Heat Pump was listed on our paperwork at a cost of $4495. Since we never received the heat pump we had already overpaid $2300.45 and this was before we knew true amount from the outstanding lien notices. We also never received the Pool Shark or "Pool School", and our Chlorinater was left in a box on our back deck and never installed into the pipework. We were fortunate that 2 of the 4 contractors sending lien notices had been paid by Capital Pool and our pool construction was close to completion with some loose ends unresolved. The other 2 companies, Hawkins Electric and Florida Pool Finishers have not been paid by Capital Pool. They have been victims as well. I obtained the legal services of David Townsend of Townsend & Brannon in Tampa to see what type of legal recourse we have. We are still waiting to see how everythings turns out. We were able to get our local "Pinch-A-Penny" to supply a heat pump, a pool shark, install the chlorinator and give us a course on how to operate the whole deal-they have been a life saver and continue to lend supportive pool info when needed. Here are the numbers: Pinch-A-Penny-Heat Pump +$3199.99 Great White Pool Shark + 399.99 Pool Service and Labor + 350.00 Lien-Hawkins Electric + 1000.00 Lien-Florida Pool Finishers + 2281.30 Sub-total =$7231.28 Last Cap Pool payment -2194.55 Total =$5036.73 As you see by backing out the last scheduled payment to Capital Pool we still ended up overpaying Capital Pool $5036.73. This does not include taxes and attorny fees. After seeing the channel 8 news story the other night it looks like we were luckier than most. This does not take away the fact that we were ripped off for 5036.73. M Hall

My name is Jarrell Marcum, I find it amazing the false information that Mr Hall is telling. I am NOT associated with Capital Pools in any matter except being a sub contractor and that is all. I am sorry that this situation has happened to the good people that it has affected. There are EXACTLY 11 pools that were not finished not 23 mr hall (your comment about this is an out right lie) . The home owners were not the only people affected by this it has taken a hard financial toll on the subs as well.We (the subs) depend on prompt payment for our paychecks. What Greg luce has done is his problem not mine and he will have to answer for his actions when the time comes.Mr Hall I know that you "STILL OWE" Capitals Pools $2344.55 for the heat pump you refused to pay for and expected Capital Pools to give it to you free. Read your contract you have to pay for the product in order to receive it. You have been enjoying your pool and you personnally have told me that the pool looks great. I realize your pool was not finished in a timely matter, this has no regards to myself. You forgot to mention your pool is Finished but without a heat pump,(which you refused to pay for). I have documentation of all your records that I can make public if need be, and then the public will know who is lying. I take a lot of pride and respect for the work that I do, remember your fan jets for your pool instead of deck jets? You liked my work then huh? I find your personnal attack on me very slanderious and defaming. I am only trying to help the 11 people involved and do you expect me to pay for a companys mistakes? I'm sure that in your work,when you have worked for other people you did not pay for there financial mistakes.This is why I have taken care of the people to help finish there pools,because unlike you I know what the next guy coming will do to the home owners.
