Beware of David C Sutton with Corporate Auto Brokers in Indianapolis. He sells items on Ebay and outside of Ebay (to avoid Ebay fees) but does not followthru with promises of delivery or refunds.

My story is a long one, but if you read all the details, you will at least become aware of things to look out for.

David C Sutton also lists his name as Charles D Suton and his wife Wendy is also a partner in the lies and deceipt. From what others who have been ripped off by David Sutton have told me, he has changed his email address in the past.

We purchased a quad on Ebay for $3,750 but David Sutton claims that due to someone messing with his PayPal account and also that PayPal would not allow him to draw more than $500 out of his account, he required the money be wired to his bank or a check sent to him. The agreement was that for this purchase price, he would cover the cost of shipping and make the shipping arrangements. This was back on June 2, 2007.

After receiving our money on June 4th, we began the long journey of constantly having to call him trying to obtain shipping information, with most calls and emails being ignored. I assumed he was using his caller ID to screen our calls, so when I called from a different phone, he answered. He would make excuses like he didn't know that the money had been transferred, even though I spoke directly to his wife Wendy the day the money was being transferred.

During this time I also explained that we had some plans to be gone and wanted to confirm the shipment and delivery information to be sure we were home when the quad was scheduled to arrive. After a couple more weeks of not getting our requested information, we finally received an email back from David saying that he was not going to spend $1,000 to ship the quad and that we could just come pick it up (not an option since he's in Indiana and we're in Oregon). Also, we had paid him to ship it as part of the cost of the quad.

David said if it didn't ship out within the next week he would refund our money. On July 2nd, I called David requesting the shipping information. He was "camping" and didn't have the details to give us but said the quad had been picked up by a shipper (he couldn't give me the name of the shipper) on the 28th of June. David said he would call me when he got home from camping.

After another week of no calls, I called his work # and got a message that the mailbox was full and no messges could be left. By now it's July 13th, so I started leaving messges on Wendy's cell phone (his wife). More emails were sent demanding shipping information but were ignored. We knew that David was still around because new Ebay listings were being posted and he was also responding to questions that friends of ours were asking regarding his new items for sale.

On July 13th, we emailed David again, this time asking where the title was that he had promised to send the day after the funds were wired to his account. His wife (Wendy) responded that David was gone racing but if we told her the item we had purchased, she would send out the title the next day. After we told her, we never received a response back from her or the title.

At this point, we contacted Ebay to report that we felt we had been scammed and unfortunately, more than 35 days had elapsed from the time the auction closed and you have to report ripoffs within 35 days. We believe David knew this and "strung us along" just long enough with the promised shipping that we would not have recourse with them.

We have since confirmed with several others around the country who have made purchases from David Sutton that they too have been ripped off and scammed by David Sutton and they have forwarded their stories to me. All who have had the misfortunate of dealing with David Sutton have the same comments.....he makes promises that he has no intention of keeping. If you challenge him or question his integrity, he goes off in a tiraid of profanity and threats. It is more important for him to attend his "racing" events than provide good customer service and he does not communicate with you except in the beginning when he's trying to make the sale. After that, very little or no communication, except to make threats and sling profanity.

The next "story" David created was that he had a truck driver scheduled to deliver our quad but after going from Indiana to Maine to Pennsylvania to Texas to California, the truck driver got "popped for smog" in California and was driving the truck back to Indiana. On August 1st, he said he would wire us a refund if we would provide him with our bank information (which we did).

On August 6th, David responded to our email requesting status of wiring the money by saying that he would first need to sell the quad in order to get the money to refund us. He claims that when he sold it to us, he had to first pay the bank off so he no longer had our money. The other option he gave us was for us to make arrangements to have it shipped and he would be happy to take the quad (in a crate) to a dock to be picked up. He claims that the truck driver he used had been paid $490 and the truck driver had not refunded him this money.

I called the truck driver to confirm this and he got very upset saying the David Sutton was "dragging him into his mess" and that David had never paid him anything to ship. When I asked him if he ever really even had our quad, he refused to answer and hung up. We are thinking this "truck driver friend" was also in on the scam because when I asked him for copies of paperwork, he claims he sold his truck as soon as he got back to Indiana from California and has been in the hospital due to heart problems and problems with his pacemaker. In his condition, it really doesn't sound like he'd be qualified to be driving a truck. I informed the truck driver that we were considering taking legal action against David Sutton.

Before we could even secure a shipper, we saw that David he relisted our quad on Ebay. We saw that it had sold and we received an email from David saying he would be sending us a refund as soon as the buyer paid him and then decided instead he would just have the buyer pay us directly. I informed him that we didn't want to count on a 3rd party to pay us and I doubted that the buyer would send money to us since we didn't even have the quad. Since he had also sold it for less than he owed us, we wanted him to be responsible for paying us the full amount. He agreed and told us he would wire us the money as soon as the buyer paid him. This was on August 19th.

We received a nasty email from David Sutton saying that the truck driver had informed him that we were planning some type of legal action and he made some threats and that we'd be sorry.

On August 31st, we attempted to "mediate" through an ebay service called Square Trade. Unfortunately, David provided the mediator with false information on costs he had incurred and after sending the mediator the real facts (which she was able to prove), she closed the mediation.

We are not in the process of working with the Indiana Attorney General's office who has recently contacted David Sutton. David Sutton emailed another guy who has also filed a complaint with the Attorney General's office and threatened to get him listed as a child sex offender in retaliation for what he is doing with the Attorney General. Of course, this is not deterring the other guy (who also wrote in a complaint on this Rip Off Report site) because David is ALL TALK (mostly profanity) and THREATS. He has had legal trouble in the past (done some jail time too) and even if we aren't able to recover our money, we will be pursing every avenue to prevent others from being in the same situation we are and to make him accountable for his actions.

I have a folder with about an inch of documentation to verify the above information and several others who have also been in contact with me do as well. This guy is a hot head who tries to intimidate anyone who challenges him. Unfortunately for him, we will not be going away quietly and will continue to pursue this until something is done. I have all the time in the world!!
