Why would anyone suspend their "buyer beware" attitude for any reason? Did you expect new car salesmen to be more honest than used car salesmen? Really?
If you can prove that you were sold a car with an undisclosed damage history, that should be a slam dunk in small claims (and cheap to file). You'll also have to prove that your damaged vehicle is worth less than an equivalent undamaged vehicle (not too difficult).
