Ebay suspended me after I have filed a lawsuit against them for fraud ripoff San Jose California
I had filed a lawsuit against Ebay for not providing a safe place to conduct business. In 2004 I had paid over $6,900.00 to Pam And Jim Donnelly. I never received anything. I emailed and emailed ebay for help and all that I received was cookie cutter answers telling me to work it out with her.
What I did not know when I had bid was that Pam & Jim Donnelly were being investigated by the police way before I placed a bid and several people had complained to ebay and typed in their user ID in the comminuty chat room just to have ebay wipe them off.
Pam & Jim Donnelly were power sellers which ebay makes a ton of money on. I think that money is all Ebay was concerned with as they allowed them to sell items that were fake and actually never sent what was bid on. If I had known and was made aware that there were problems on ebay I would not have bid.
During these years I have had several operations on my legs and I could have used the money. I had worked with ebay up until now. I filed a lawsuit in my county courthouse, the day before yesterday Ebay's lawyer called me and asked me to drop the lawsuit. When I told him that I had worked with Ebay since 2004 to get my money back he threatened to have a change on venue to california or to have the case dropped altogether because they want me to go to arbitration. I think that arbitration would have been great if they had worked with me in 2004, 2005, 2006 and now 2007, I have had it, there is no reason a company as big as Ebay cannot stop people from selling and trading fraud items.
After I had told the attorney that I would not drop the lawsuit I received an overnight package by FedEx from ebay. I wish that I could attach it so that everyone can see, but in it the letter says the same thing, they are trying to strong arm me or bully me into dropping the lawsuit. Not only that Ebay suspended my account today so that I cannot pay for the items that I won. I feel so drained of energy dealing with this, it feels like I am in school and the school bully is beating me up.
Well, I can tell you this I will not drop this lawsuit, although not a large amount of money to me it is a million dollars. I have a medtronic pump implanted in my stomach with a catheter attached to my spine so that pain medication can go to my legs to help the horrible pain. I wished that I had much more money but I need this to help pay for medication, a new operation and doctors visits.
When I go to small claims court I will only be able to get $5,000.00 so I will be short. I really wish that I could actually get a break in life and not have to worry about money. The money that I lost could have been in a bank or in an investment and been worth alot more thant what it was. I have all of my paperwork to back me up so if some media would like to speak to me that would be great, anything to let people know ebay will not help you.
