I'm sure this insurance company, Infinity, is one of the WORST rated in the country.  They are denying fault of an accident that the local police stated in their report that their (Infinity's) driver was 100% at fault.  They also cited and fined this driver.

Infinity says that it is comparitive negligence because my daughter had passengers in the car and she was not supposed to due to California law. 

To get to this point, (we are closing in on two years since the accident), Infinity first said they didn't think their insured was covered, then, he was covered but they were investigating, then the comparitive fault BS, then they were going to settle and asked me to itemize my claim, which I did.

Now, they are back to comparitive fault BS and the only way to pursue it further is to file a civil claim against them.  Oh, and their turbo charged staff attorney told me that the police report was heresay and would not be admisable.  I said, "we'll see about that", and then he hung up on me.  I guess their "investigation" has more credence than the police report!!  Ha!  I'll see them in court. 

What is funny about this is that we are only arguing about $3,000 in property damage and $2,000 in medical expenses.  This company will do everything and anything in its power to not honor a claim.  God help you if you get into an accident with a driver with Infinity.  The SCUMBAGS of the Insurance Industry.

   If it was me, I'd have filed a small claims suit after a couple of months.   If you've got all of your documentation and witnesses in place, you could have it over and done with in a month or so (depending on the court schedule).

    Two years is just ridiculous for a claim of this size.  I think the insurance company is hoping that some of your witnesses or documentation has disappeared in the intervening time.   Long delays general benefit the insurer in the long run.
