My brother-in-law purchased a 2006 truck from Jumbo Auto & Truck Plaza 8/11/07. However due to repair work he was unable to take the truck. The dealership promised the truck would be ready on 8/25/07 it was not ready. My brother-in-law contacted the General Manager Bobby Barrento who promised the truck would be ready 8/29/07 truck was not ready. Emails were sent and on 9/1/07 Mr Barrento promised on an email the truck would be ready in the early part of the following week (Labor Day week, 9/3/07). On 9/4/07 the dealership was contacted again and they promised the truck would be ready on 9/5/2006. The truck was not ready.
On 9/8/07 the General Manager was contacted and again he explained the truck would be ready on 9/10/07, which is still pending. My brother-in-law has paid insurance for the truck that has not left the dealership. He has also paid the first monthly payment for the truck he does not have in his possession. He bought this truck to use for business purposes and since the truck was promised on 8/25/07 he made appointments with his clients after 8/25/07.
After finding out the truck was not ready. He had to rent a truck in order to meet his clients needs. My brother-in-law has loss wages, paid the insurance company and the financing company for a truck he does not have. He total loss is 1,842.00 not counting the headaches. He wants to cancel. Please advise what can we do. He wants reimbursement for the rental truck and payments made to the finance company and two payments made to auto insurance.
