I AM SUBMITTING THIS COMPLAINT ON BEHALF OF MY 10 YEAR OLD DAUGHTER. SHE HAD RECIEVED AN OUTFIT FROM A GOOD FRIEND OF THE FAMILY FORM K-MART FOR HER BIRTHDAY, UNFORTUNATLY THEY WERE A COUPLE OF SIZES TOO BIG. AFTER THE PARTY MY DAUGHTER AND I WENT TO OUR LOCAL K-MART TO EXCHANGE THE PAINTS.

THE CLERK TOLD US THE PAINTS WERE ONLY $10.00 BUT IT DIDN'T MATTER, IT WAS ONLY AN EXCHANGE (I DIDN'T HAVE A RECIEPT, CONSIDERING IT WAS A GIFT) AND TO GO FIND THE RIGHT SIZE.

WHEN ARRIVING AT THE CHILDREN'S DEPARTMENT WE RELIZED THEY DID NOT HAVE HER SIZE, OR ANYTHING CLOSE. SO WE RETURNED TO THE SERVICE DESK AND TOLD THE CLERK THEY WERE OUT OF HER SIZE, SHE INFORMED US WE COULD GET $5.00. WHAT THE HELL HAPPENED TO THE $10.00 THAT IT ORIGINALY SCANNED IN FOR?

I GUESS SHE NEEDED TO MAKE AN EXTRA $5.00 (CONSIDERING SHE PROBBLY ONLY MAKES MINIUM WAGE) OFF A 10 YEAR OLD. COME ON!!! SHE THEN INFOMED US W/OUT A RECIEOT WE WOULD HAVE TO TAKE HALF PRICE. I THINK THIS IS JUST DISPICTABLE. MY DAUGHTER WAS VERY UPSET, SHE TOUGHT SHE WOULD HAVE AT LEAST $10.00 IN CREDIT (NOT AT K-MART).

ALSO, THE CLERK BECAME EXTREMLY RUDE TOWRDS THE END OF OUR VISIT. I AM REALLY UOSET W/ THE WAY WE WERE TREATED. ANSWER ME THIS, WHY WHEN I WANTED TO EXCHANGE WERE WE GOING TO GET$10.00 AND WHEN WE WERE UNALE TO EXCHANGE COULD WE ONLY GET $5.00 FOR A PAIR OF THERE PAINTS W/ THERE TICKET STILL ON THEM. MY ADVICE IS TO NEVER BUY A GIFT FROM K-MART. THEY WILL RIP YOUR FRIENDS OFF NO MATTER HOW OLD THEY ARE.

u know it is pretty bad when a store rips off a 10 year old kid, and im sure this little girl at her age is suppose to understand that you have to have a reciept when u make a return to a store. my god give me a break she is a kid there has been times that my children have gotten tings for their birthdays and or christmas and they did not get a reciept with the gift and the store has gladly returned it if there was something wrong with it .u have people out here in this world who thinks it is quite fun to rip off stores and then u have the honest folks out there give me a break please this was a child peoplea 10 year old child. well ill tell u this much for one if i would of been this childs mother first of all i wouldnt of put up with the rudeness of the cashier i would of demanded to see the store manger right then and there and for 2 i wouldnt off left that store untill they would of made it right with the return amount of the purchase if u want to get tecnical if the store does not have the item ur looking for in ur size like the little girl was looking for the pants then they should have to let her get something else of equall value for the amount of the return this is why i dont shop at K-Mart people cause i know how they are . ps and to the little girl this happened too im so sorry that u had to be treated so rudely expecially on a special day lilke ur birthday

I am a K-mart employee. It is true about the exchange and refund policy. The date is given on the bottom of your receipt or gift receipt. This also applies to Layaway ( one thing not many stores have anymore). It is also true that making a purchase with your credit card allows K-Mart to look for the purchased item. Please remember that the rules K-mart is now inforcing are not all that different from most stores. Also the Associates of K-Mart do not make the rules but we have to follow them just like everyone else. Even I've wanted to return an item , had paid cash and couldn't find the receipt. So what did I do? I added it to a box of donations and made sure I included it for full price with my tax deductions. There are many needy out there. One last reminder for everyone. Ask for a gift receipt where ever you shop then make a file for them. Most people do for warrenties any how so add another. We are all people and all have a bad day now and then smile maybe someone else is haveing a worse day than you.

I would like to comment about how K-Mart just filed bankruptcy. It doesn't matter is they filed chapter 11 or 7, alot a people have still been screwed by K-Mart. My company for instance has lost over $5,000 to K-Mart because of bills that they filed bankrupt on that they now will never pay. Now you tell me, is that fair??

there is a difference between chapter 11 and chapter 7. right away everyone hears bankruptcy and thinks the store is closing. chapter 7 is when the store is closing. chapter 11 is to get help. just because some of u people had bad experiences at kmart right away u say thats why your going out of business. you listened carefully enough to the news to hear bankrupt but not to hear the explanation. even if they do go out of business we will still be getting a check will u???? so next time take your fingers out of your ears and listen to everything that has to be said. anyone that needs more info i would be more than happy to assist u!!!!

you know what is really funny? how customers take the time out to read the reciept before they leave to make sure they were not overcharged for snything they purcahsed but they can't read down a few more lines where it says you have until such an such a date to return what you have purchased WITH YOUR RECIEPT! i think k-mart is totally right for what they did, the person who purchased the pants should have gotten a gift recipt just in case the pants did not fit. k-mart is not the one to blame!!

We all understand that these articles of clothing were gifts. You obviously don't shop vey often. Stores have policies and regulations which consumers have to follow. Even though these pants were a gift, how would K-Mart know that. How would they know that the pants were not stolen. And what if they were stolen and the sales associate gave you money back for something that was never purchased in the first place? That is what keeps prices high in stores. Bottom line is YOU HAVE TO HAVE A RECEIPT. YOU DONT!!!If you went through all of this trouble to submit a RipOffReport you could have gone an extra mile and got the receipt from the people who gave your daughter the $10!!!!!!!!!!!!! You are wasting your life and my timer reading your crap! You are talking about a pair of $10 pants from K-Mart. Anyway, since you are bad-mouthing K-Mart employees and making implications that the employee needed the other $5 out of the $10 she would've give you, I am going to tell you something. I guess you make less money than the employee since you are flying off the hook about a pair of pants that someone that enough of your child to buy /LOL. Be greatful someone likes your child, I'm pretty sure they don't like you. You sound like you're pretty money conscience, maybe half-way rich. Why don't take some of that money and BUY SOME PANTS THAT FIT!!!!!!!!!!!!!!!!!!!!!!!!!!!!

It's too bad you didn't have a receipt!In my store my girls have no problem refunding or exchanging any item with the receipt within the 90 day policy. The policy has always been that w/out a receipt you get the lowest sale price within the last 12 weeks- store credit. As of January the policy has changed... without a receipt you get nothing.No store credit.. nothing. But if you pay by credit card, check, store credit or use an employye discount card we can now trace the purchase. I totally agree w/ the policy. I have had customers who bring backitems from 2,3 and even 4 years ago (the merchandise doesn't even ring up in the system cuz they are so old!)and actually have the audacity to get an attitude w/ me cuz they want a refund PLUS for the price that is marked on the tag! There are also some people who come into the store empty handed or with empty shopping bags and then come down to the service desk and want a refund... HELLO... they tok it right off the shelf and want "their money" back? The nerve of some people.And for everyones information... we all don't make $5 and hour.. we are just like everyone else trying to make a living. I am a manager in a K-mart and I do have an education!! I can spell correctly... can you??????? Have a great day and "Thank you for shopping at the big K!!"

I do not work for K-Mart but I have worked in Discount Retail for 12 Years. You would not believe the amount of people who try anything to get fraudulent refunds. People will bring in empty bags and fill them with merchandise, then go to the service desk just to get a merchandise credit to spend in the store. One more example which really takes the cake. My store was running a promotion that if you cashed you x-mas club check with us we would give you a free x-mas ornament. One customer opened up many accounts and just put $5.00 in each, then brought the checks to us to cash. (This promo was one we ran every year. so she was good at her game) We cashed her checks, she got her free ornaments, then came to the service desk to get a refund on her f-r-e-e ornaments. It is a shame that stores have to make return policies so strict, but it is just a sign of the times we are living in. This same customer also would come in the store and take all of the decorative pins which came on the blazers we sold, she assumed since they were free with the blazers, she could have them. Just a few bad apples ruin it for all good, honest customers Angie Retail store clerk for 12 years.


My opinion though is a bit different.

My opinion though is a bit different. It is a priveledge to be able to return an item purchased or have your money refunded. Believe me, in many countries, once it is bought; broken, defected, not the right size shape or color, it is yours for life! Your daughter received a "gift". She wasn't out any money. She could have kept the pants as a reminder of the thoughtfullness she was given or, she could return that gift and not receive the "value" that might have been paid but, used the money, given, to purchase something else or save it towards something really desired. Unfortunately, crooks do exist in our soceity. They steal pocketable items like cd's and such and try to return their stolen collection in order to walk out the door "legally" with a T.V. or stereo. Receipts are truly the way to go for both sides of the fence. It validates the purchase plus the amount paid. Using parking garages; you only parked one hour but, don't have the ticket to prove it, you pay for a whole days use! K-mart is no different from any other business. The purchaser of the gift is out the value of their purchase, not your little girl.

Sorry I got you all steamed up! Hope you don't expect me to agree with your analysis that if we demanded honesty from retailers the economy would dry up. Matter of fact, if 'major retailers' like the ones you mentioned don't begin to respond to consumers who insist that they be treated honestly and with dignity, they will be replaced by ones who do. I can't beleive that there are those out there that think that consumers should
just eat it from retailers. Look, it's as simple as it sounds- if certain retailers can't figure it out that consumers are not going to allow themselves to be ripped off any more, continue to abuse consumers and go out of business, I can assure you, there will be a dozen more retailers willing to compete for our business. There was never a store that went out of business because they respected there customers. There are,
however, hundreds that never figured out that their profits came from consumers, and they are no longer with us. Justin, being an apologist for bad retailers will not help them- they need to know what they are doing wrong or they will not survive. As far as not knowing what I'm talking about, I've been in retail for over twenty years now and I've seen what works and what doesn't. Faulty economics like yours and 'the sky will fall' prophecies just don't cut it with me. Stores will improve when we
force them to by witholding our dollars. When Target and others see our dollars going to their competitors, they will make the necessary adjustments or die. And if they die, there will be smarter retailers to take their place. Hide and watch!

If anyone opens a store where the customers are not treated like theives, where they can get a refund for goods that aren't suitable for whatever reason, that store will
clean up. Now that most stores have trained US to jump through hoops and perform like trained animals, they can pretty much demand anything from us like it is a privilege for us to be their customers. This has gotta change!

Rebuttal:
Many years ago unethical consumers discovered a way to make a profit from the very liberal refund policies of large retailers. They would purchase items at %50 off sales and come in the next day and tell the customer service they bought the clothing weeks before. A clever con could make several hundred dollars a week.

Before long the stores caught on when the profits began to sag. It is now the policy of all retailers to refund at the current retail price of an item when there is NO RECEIPT. This is no reflection on law abiding citizens like yourself. You're blaming the wrong person for the policy--blame all the thieves that caused it.

Children are like sponges, they absorb everything we put out. Your daughter watched you throw a fit and in turn became very upset. You ruined your daughter's day with your childish behavior.

You should have acted like it was OK, even if it wasn't in *your* mind. Later you could have thrown a fit with the manager without your little audience. If you had done that your daughter's 10th birthday wouldn't have been ruined. Don't blame it on the store, look in the mirror.

The $5.00 you were going to be recieving was not some evil scheme by k-mart. Without a reciept they were merely giving you the lowest sale price on the item. How are they to know if you paid $10.00 or $5.00? If they gave u what the current price of the item was what would stop you from going and buying a bunch of items at sale price and turning around and returning them once they went off sale? Maybe next time you should get a receipt for the item you would like to return.

First off the rules of the returns are clearly stated on the receipts for K-Mart among other retail outlets. As much as I wish they were different they are not. I have 4 little girls ages 13, 8, 6, and 2. There have been many times that we needed to return an item but we were able to read the back of the receipt clearly. I do feel for the little girl but where is the person who bought it for her. She may want to know if the
pants fit and how they look. Mabe if you let her know she may find the receipt and if she threw it away well that is the person at fault not K-Mart. It is a bummer but without these rules of return we would not have a K-Mart. I have talked to all of my children about these rules over and over again so they clearly understand them as they hold true to almost every retail outlet. With that in mind I do wish there was something I
could do to help the little girl this time and explain the rules so she can understand for next time.
