CHECK THIS OUT! Nissan USA's department for consumer affairs is located in Toronto, Ontario, Canada, (ok, at least not India) but same effect! less American jobs! Back to the issue of my problem. I agree with Robert 100% that this problem was caused by the CA DMV. using this point of view I would like to ask this, how is it that Nissan or any automobile manufacture can just cancel a new vehicle warranty because of a DMV error? Let me explain my position. This is a brand new vehicle, the Nissan employee that made the decision to VOID the warranty had to see the record for the vehicle there fore had see it was a brand new vehicle and the recorded mileage in dispute with the DMV is only 28 miles. So why is it acceptable for Nissan not to notify me right away and tell me there is a problem? Why are they not required to notify me? what if there really is some type of fraud from the dealer? Before you reply, remember I only gave the dealer 900.00 I financed 35,000 through NMAC, this means I don't get to see the TITLE for the vehicle, NISSAN HOLDS THE TITLE!!!!!! how the hell am I to know there is this NOT ACTUAL MILAGE PROBLEM??? by the way I asked the investigator IN THE CA DMV, how Nissan was notified. She told me that Nissan had to pull it themselves because they don't send out any notice's!!! So why is it Nissan pulls this information and would just cut the new vehicle off no questions asked? A consumer affairs rep told me last week that they were notified Feb 10th of 2006, I think I know what happened now, I took the vehicle in for its first service at the dealer that sold me the vehicle and guess what, yep I serviced it on Feb 10th 2006! Robert, I'm afraid you may be right, bottom line is Nissan is taking that stand. But come on, remember I didn't buy the vehicle out right so I wasn't sent a copy of the title, so how am I to know the DMV made an error when regestering the vehicle? My point is this, had Nissan notified me or the dealer right away, (when they cancelled the new vehicle warranty) we could straightened this out right away with no problem. Come on Robert, this was a new vehicle with a loan from NMAC!! why do you think is it accaptable for Nissan to just cancel the warranty with out advising me the new vehicle their dealer sold me has a problem with the milage or at the very least contact the dealer to find out what is going on? Your reply is the same as Nissan and as far as I'm concerned it is not accaptable. The Nissan employee could see the record of the vehicle, therefore they would know it was sold by a Nissan dealer as a new vehicle and this should have caused a further investagition to the issue and the dealer and I should have been notified at-once. the fact that they did nothing caused the problem to escalate to the point it is at today. If you think they handled the situation correctly, you had better never buy a new vehicle from Nissan, this could happen to you also. Mel

The CA DMV made the mistake. You even have a letter from the DMV that says they "screwed up". This effectivly takes Nissan off the hook for a majority of the issues if you tried to get some compensation from them. Yes Nissan probably should have known to direct you there sooner, but is this enough for them to provide any sort of compensation??? Now, once this was fixed by the DMV then it becomes a totally separate issue. Nissan should reinstate the warranty if that is the reason it was cancelled. Since it was sold in CA you probably have to deal with the CA regulations. Hopefully you have the Warranty Suplement from your Nissan still. If so it lists by state the process to take for warranty issues. For CA it seems to mainly deal with the "lemon law" but may apply in your situation. I would post it here but it is about 2 pages of text that I would need to type in. If you did try to push it in court, even in the best scenerio you are NOT going to get a full refund on a 2.5 year old vehicle that you didn't even need to use the warranty until a year later. Remember it was the DMV's fault and not Nissan in the beginning. However, it would be a very simple case to get at least your out of pocket costs for anything that should have been covered under warranty. The question is who do you go after the DMV(who made the mistake) or Nissan(who cancelled your warranty because of the DMV's mistake)?
