February 18, 2005 I saw an add in the local paper in regards to 2004 350zs. The add indicated that several 04 models were on the lot for purchase at deep discounts due to the 05 models that had already arrived. "NOT A LEASE" was advertised on the ad. I made a phone call and spoke with Bill Ryan. He indicated that several 04 models were left and asked the time I would be arriving.

I arrived on the lot about two hours later with the article in that days paper. I told Mr Ryan I want to see 04 350zs. He indicated to me in person that the 04 models were all sold. In fact they had been sold several weeks earlier. (1st lie) He asked me not to leave. Lets drive a 05 model. I did. He indicated to me that I would be able to get the monthly payments I wanted with the car I was trading.

I made it very, very clear that I was not interested in a lease. Mr Ryan assured me that the monthly payments was not a lease. I financed through Nissan/Infinity. All paper work was signed and sealed. I was given the keys to my new Z and was told to enjoy the car. I was missing copies of all the paperwork from the signing of the contracts.

I asked Mr Ryan about my copies. He indicated that it would be mailed to me with in one week. I told him I needed some kind of paperwork before leaving the dealership. He assured me that this was typical procedure. I asked to talk with his Manager. I do not recall his name. The Manager himself told me that what Mr Ryan told me was correct, I do not need any copies of the contracts to leave the dealership. I was given a firm handshake and told that it would all arrive in the mail about a week. I spoke with the Manager himself. You can trust the Manager of any business right?

5 days passed and I had not received a single copy of the contract I had signed. I was at my place of employment when a co-worker of mine said that a representitive from North Texas Nissan was on the property looking for me. I was relieved from my duties to meet this person. I was not sure what to expect. I met the representitive. He told me that I needed to sign the paperwork to my new car. I told him that I signed all the paperwork the day I took delivery of my car. He indicated I had not.

I phoned Mr Ryan. Mr. Ryan told me I had to sign the contract with no other explanation of what was taking place. I told him I wanted my old car back. He told me it was already sold and no longer available. If I wanted wheels to get to and from work I had to sign the contract. I was also told that if I did not sign the contract since the financing was through Nissan/Infinity that it would be a default on my loan. I was experiencing the full definition of Duress.

Details of the second contract.

The date of the contract is January 18, 2005 not February. Lease of 5 years. The Security Plus extended warranty was added for the term of the lease Automatically. 12,000 miles a year, .15 cents a mile over in excess and purchase price of $11,283.20 at term end.

I was taken Hook,Line,and Sinker. Not sure if I will ever purchase another nissan product. I have tried to get out of this lease several times. The way the contract is written, I will be upside down until year 5.

A few individuals have indicated that I somehow misread information in the contract about the lease. As stated in my original report, Representatives from North Texas Nissan drove all the way to my place of Employment (1 hour away) to have a new contract signed with out a single phone call of communication indicating anyone was trying to get a hold of me. Needless to say I do not take this car to NTN for any of its Service. I live very close to Bankston Nissan in Irving. I took the car in to have a small leak fixed in the hatch area. I took the car back several times before the fix was resolved. On the last trip to this dealership, I was told that the car needed to stay a few days. I was given a rental via Enterprise. A few days later, I received a phone call indicating my car was ready for pick up. I drove to the dealership. I picked up my car and was driving off the lot when I noticed my computer flashing no miles left due to gas and I noticed the needle way below the empty mark. I drove the car back to the bay. I spoke with the manager and asked if my car was used for errands? I was told no. I grabbed my invoice and looked at the odomiter and noticed a 89 mile difference. This Mgr was next to the GM of Bankston. The General Manager looked at the invoice and odomiter and stated somethings wrong I will give you a full tank of gas. On the way home via the freeway, I notice the car pulling to the right rather hard. I down shifted to slow down and the shifter came off and ended up in my hand. I drove back to the dealership. They were closed. I drove the car back home. I got out and looked the car over. The dash, console, radio, all plastic in the rear hatch area had all been popped out of place. In addition, I found a steak knife and fork under the drivers seat a long with other nissan tools. I took a look around the outside of the car. I was at the rear of the car and and noticed that on the right hand side facing fwd that the plastic that makes up the rear bumper was moved one inch to the right. I walked over to the left side of the bumper was moved inward to the right. I returned to Bankston of Irving Monday morning. I spoke with the same GM that I did the past Saturday. He remembered me and said ,"Is it the car?" I indicated yes. I was given a rental from Enterprise. My car stayed a week at the dealership. All plastic was replaced. (I have the original seats and carpet) The car was looked over from top to bottom. The clutch was taken apart, New Alignment, Car was taken to the Body Shop to get a new Rear End. In addition I get free oil changes. I had free gas for 6 months. When the Enterprise car was returned, I ran into the representitive who I rented the car from the first time. He indicated "Your back so soon" I let him know that someone had taken my car out for a joy ride. He asked, "Do you drive a Z?" I said yes. This representitive shared with me that I was the third Z owner in less than 6 months who had there car taken for a joy ride. People, I am not making this stuff up. I have owned a 300zx, Maxima, Altima and now a unwanted lease of a 350z. I have never had a single problem with any Nissan products until now. It is not just limited to one dealership. Sir, I have had to obtain lease payoffs on several occasions from NIMAC. It was like nothing I've ever seen. I did indeed have to wait about a week to receive it in the mail, every single time I needed to do it. I'd say my statement was pretty accurate and more than fair.

Getting a payoff on a lease from Nissan (NMAC) is very easy. Simply call 1-800-274-6622. This number will give you an accurate payoff on the spot. The statement that Nissan has to figure your payoff and mail it to you is simpy not true and not fair to Nissan or the dealer.

Nissan (nimac) is pretty big on leases. It's a shame they tricked you into thinking it was a purchase, but I can not help but think that it was indicated on the contract you signed. If it is not what you wanted, you probably should never have signed it. I do have some more bad news for you though.... If you thought the whole concept of leasing a vehicle was bad for you, just wait until you try to get out of it. Nissan is plenty rough when it comes to this. Here's a little proof - Call nimac and ask them what the payoff on it is. It'll take them about a week to figure it out and mail it to you, and trust me, it wont be what you think it is. Their terms are very, how shall I say it, "conducive" to repeat business.

After writting the report, I looked at the contract. My financing was done by a man named Sean Hodges. Do not believe a single word that comes out of this mans mouth.
