In June of 2005 I leased a 2005 Nissan Murano from them and I loved it and had no problems. I leased the vehicle in just my name only on a 3 year lease and I handled everything myself. I was really worried with leasing but the sales pitch they gave me was awesome but I was stil concerned with going over my mileage.

The sales guy at the time told me to do not worry about the going over mileage as long as I trade the vehicle in through Pat Peck when my lease is up and re-lease another vehicle through them then they do no hit you that bad with miles and what miles they do hit me with they will just roll into the other vehicle I lease, etc but if I just turned in my keys when my lease was up and did not trade through Pat Peck for another vehicle then I would get hit with all the mileage, etc. So that is what I exactly did.

I drove the vehicle for 3 years and did not worry as much about going over my mileage because I knew that I was going to get another vehicle through Pat Peck Nissan of Mobile because I loved Nissans and at the time loved dealing with Pat Peck Nissan.

In June of 2008 I went to Pat Peck to trade in my lease since my lease was up the first of that month and to release another vehicle.

When I first got there a sales guy walked out and asked if he could help me. I expalined to him that I was leasing the Murano and my lease ended in June of 2008 and I wanted to trade it in on another lease but had to keep my payment under $400 and was over my mileage. So first my slales guy and I walked around lot looking and I found several vehicle that I was interested in and even drove a 2009 Murano and a 2009 Nissan Maxima and I loved both of them and really wanted the 2009 Nissan Maxima so me and him finally went into one of those little sales office inside at Pat Peck Nissan.

He asked for my account number on the Murano through Nissan Motor Acceptance so I gave him my account # and info to Nissan Motor Acceptance he called and got a payoff on my Murano then asked for my keys to the Murano. Then he went to his supervisor in the sales department and I watched them as they talked and then I saw the sales manager get in my Murano and drive it off the block and then he came back in my Murano and was looking all around it, under the hood, etc. just as someone would do when you would trade your vehicle in.

Then my sales guy came back and said my payment would be over $500 on leasing the 2009 Murano and the 2009 Altima do to I have the hits on my trade in on the Murano for the mileage, etc. So I searched and searched but we couldnt find anything to keep my payment at or under $400. Every vehicle I found that I loved and wanted, He would say (We can not fit you in that because your payments will be way over $400.00.

So long story short my sales guy told me he had a 2008 Nissan Altima on the lot that he can get your payments to under $400 so I drove the 2008 Altima by this time I was tired, stressed and just ready to trade in my Murano because I knew my lease was up and had know other choice but to trade in my lease so I decided to lease the 2008 Altima. I liked it but it was not the vehicle I really wanted but to keep my payment where I could afford them I knew I had no other choice so thats what I did. I waited around for awhile. He kept coming back saying my payments was gonna be $430 and I would say no I can not go over $400 so he went back and forth with different figures over $400 until I finally told them to just give me the keys to my Murano and I would call Nissan Motor Acceptance and see about keeping my Murano so they finally got the payments down to $400 then I went into the Finance Managers office and signed my papers on the new lease.

Starting in July I started getting phone calls after phones calls from Nissan Motor Acceptance late at night and on weekends even one time on a Sunday regarding they are not showing where my leased was turned in and I was two months past due with them for my June and July payments on the Murano. I went over everything with Nissan Motor Acceptance on the phone several different times, several different days and they would apologized and I gave them the number to Pat Peck along with my sales guys name and they said they would take care of it.

Then in August they started calling again about the same thing and I had to explain everything all over to Nissan Motor Acceptance they said that Pat Peck never sent them anything showing it was paid and I was now three payments past due on my Murano. So, I called Pat Peck Nissan and explained everything to someone (I rather not metioned names on the internet). He said he would take care of it that they have just been behind on their lease paper work and he apologized and asked for me to come in and sign a form showing I did turn in lease.

I went to Pat Peck about 1 week later to sign paper work and I spoke with same person. He told me that he took care of it and I didnt haft to sign anything after all and everything was taken care of and he apologized for all the mess I was going through. I finally thought in September that it was finally all taken care of but I was wrong.

I continued to get phone calls after phone calls and collection letters. Nissan Motor Acceptance did get proof in September that I turned in my lease but they are showing me owing them almost $3,800.00 on the Murano I traded in that I don't even have anylonger.

I continue to get phone calls from Nissan Motor Acceptance and in October and November of 2008 got even more phone calls from them were they were showing I was two payments past due on my Altima also and come to find out they applied the two of my payments I made on the Altima to the Murano I no longer have.

So, I am sure my credit is messed up do to Nissan Motor Acceptance and Pat Peck and I have always had perfect credit and never been over 30 days late on anything. I finally got the payments straightened out with Nissan Motor Acceptance after being harassed and harassed by phone calls from them. I explained to them that this better not of went of my credit and they said that if it does that I would just haft to dispute it.

In November of 2008 they actually called me 5 times in 6 days straight in a row every day and the only reason they didn't call me 6 times is because one of them days was Thanksgiving day and each time I had to explain the story over and over when I got the third call from Nissan Motor Acceptance I asked them was I being recorded and they said yes so I told them the story again and told them I was being harassed and if they call me one more time about this I was getting a Lawyer. The next day they called me again and I again explained to them do not call me anymore or I was getting a lawyer but that didn't stop them. I got the 5th phone call and I just broke down and cried. I am so tired of explaining and repeating this over and over to Nissan Motor Acceptance.

Well, to my knowledge they finally straightened out my payments and corrected them to the right account but they are still harassing me by phone and sending me letters that I owe them $3800.00 on the Murano.

I went to Pat Peck Nissan on February 2nd and spoke with one of the supervisors. I have his business card. Again I had to explain the story to him. He pulled my file and seen where Pat Peck Nissan never mailed Nissan Motor Acceptance a check for the over mileage on the Murano and so he apologized and could not give me any explanation except it was just over looked and he would have it taken care of and that would leave me with a remaining balance of $2,000.00. I explained to him I shouldn't owe anything to Nissan Motor Acceptance that this my salesperson along with the sales manager at the time treated this as a trade in and no one told me I might owe a balance on the Murano and if I would of known any of this when I turned in my Murano that I would of never been that stupid to turn it in and re-lease the 2008 Nissan Altima for $400.00. I also explained I was treated like that particular Nissan Altima was the only thing I could get to keep my payments at or under $400.00 and that is the only reason why I re-leased and got the Altima in the first place and now I am stuck with a vehicle that I am not very happy with for the next three years.

The whole time I was telling him this I couldn't stop crying I was so upset. He said he would speak with his supervisor but he was off and would be in the next day and go over all this with him and see if they could waive any of the other fees. I asked him if this wasn't a trade in like he is telling me why did my salesperson call and get a payoff right in front of me on the Murano and why did the supervisor over sales do an inspection on my Murano and drive it down the block to check it out and He could not tell me a reason why. I also asked him did a sign one form stating I might owe something on the Murano down the road and he told me no.

I also questioned the fact that Nissan Motor Acceptance had to do their own inspection on the Murano and my Murano was turned in the first of June of 2008 and the inspection was done in September of 2008. Why did it take Nissan Motor Acceptance three months to do the inspection. That anyone could have been driving my Murano for three months and damaged it. Because they are billing me for stuff that when I turned in the vehicle it didn't have all the damages they are saying. He could not come up with a reason why it took three months. All he could say is I don't know why it took so long and that he would get with the supervisor and have him call me the next day. As of 2/5/09 I have not heard from anyone at Pat Peck Nissan regarding this matter.

On 2/6/09 I called and left a message for the supervisor to call me. Still havent heard from anyone....

Why Are You In a FLEASE To Begin With???

Belinda: Your very first inclination was correct. A car FLEASE is a very bad deal for you and a very good deal for the dealer. No matter what the salesman says, its a FLEASE and YOU are the one who gets sheared. You keep throwing around the term "trade in". You had NOTHING to trade in! You didn't own that car. Do you know that? The excess milage charges are governed by the contract YOU signed and not governed by what some salesman says, unless he/she is willing to put it in writing...but then again, if you wouldn't have gotten yourself into a FLEASE, this wouldn't be an issue. When you turn in the car, the excess wear and tear CON GAME is a common practice in the sleazy car business. They routinely exagerrate the wear and tear, claim they need to make repairs and take your money. They then send the car to the auction WITHOUT making any repairs and again you were FLEASED out of your money. All thru the process you clearly indicated you were shopping for a car by monthly payment. Again, another way to get FLEASED. I'm not trying to be disrespectful here Belinda, but you did make some major mistakes in this area. NO, repeat NO personal financial advisor ever advices people to get into a CAR FLEASE. Its that BAD of a deal. Every personal financial advisor advises people to NEVER shop by monthly payment.
