Complaint Review: Robert Bailey Jr. John Homan Joseph Cirino Paradise Gardens My Lawn Care Co. Better Sheds - Williamstown New Jersey

This is in response to the rebuttal Mr. Bailey had placed. Mr. Bailey seems to have quite a bit of amnesia these days. He claims to have had no problems in the past with customers but I have been in contact with at least six other families. Families that have been taken advantage of even after Joseph Cirino left. He also claims that he had nothing to do with Fries Mill Landscaping but when I went to his office he personally handed me a business card with his name on it stating he was the owner of Fries Mill Landscaping and has been at this site for years. He stated that he did not know why Joseph Cirino was going around telling everyone that he was the owner himself.I had went to his office that day because we had hired their company to mow our lawn through the summer. Well that was also a mistake. One of his workers mowed my lawn that same day high as a kite and scalped my lawn as well as my neighbors and broke several sprinkler heads that they just installed. He said that he would make good on all the work that still needed to be done and make any repairs that were neccessary. Mr. Bailey will completely deny the conversation he had with me but I have no reason to lie. I am a well respected nurse at a major hospital and unlike Mr. Bailey I have not claimed bankruptcy for the second time in ten years. As a matter of fact I have never claimed bankruptcy ever and pay all my bills on time. He has lied under oath and will lie to any ones face without a blink. We waited and waited for Mr. Bailey to make good on everything that needed to be done but the only things that he kept his word on was replacing the damaged sprinkler heads(with incorrect heads, all mismatched) and taking the subbase for the patio that damaged my driveway into the patio area. Mr. Bailey had one of his workers do this for us. We asked his worker if he had been doing a lot of work for Mr. Bailey and he said no. He said that the only work he did was at Mr. Bailey's home installing pavers into his front steps(were these the pavers that we paid for and never recieved?). He gave us a business card and said he did work on the side and yes you guessed it this was one of his illegal workers he claims he never hired. From then on Mr. Bailey never sent anyone back out and ignored all of our calls. Every day we have to pass his company to get to our home and we have seen Mr. Bailey arguing with different customers about work that is not completed and money that had been taken from hard working innocent families. He claimed that the only company he owned was My Lawn Care Company but that is a complete lie as well. Joe Cirino left when the company was Fries Mill Landscaping and then the company changed names several times. Mr Bailey knows exactly what he is doing and he has done it before. Again this is his second time filing bankruptcy in the last ten years, beating the system and getting over on innocent people. He is far form an innocent old man and has became irrate and loud with customers especially the wives. He is a fraud and should not be trusted. As far as Joseph Cirino goes it is only a matter of time before the law catches up with him. He is far from innocent and is a crook as well. If you google his name you will find that he has pled guilty to insurance fraud in the past. He hired someone to set his car on fire so he could collect the money. We have attempted to locate him but have been unsuccessful. If you read the reports he has made you will find that he is an uneducated man. He misspells everything and makes no kind of sense.

I was the owner of bettersheds.com a part time shed business in Williamstown, NJ. I have had no problems with customers in the past and have had no problems with Consumer Affairs or Better Business Bureau. I had nothing to do with Fries Mill Landscaping/Garden Center, LLC, other than leasing the ground to Joe Cirino the owner, to run his landscaping business out of. I helped Joe run the business for about 18 months with the agreement that I would have ownership of the business. On June 18th after the business showed some potential to make money and jobs were coming in Mr. Cirino decided he was going to take his business and go else where to run it without compensating me as promised. Fries Mill had hired John Homan, who was suppose to take care of all the EP Henry sales and installations. A new company was formed with Joe Cirino, John Homan, and myself each having 1/3rd of the business. Joe to take care of landscaping and irrigation, Homan to take care of EP Henry jobs, and myself to take care of shed sales. When Joe left, Paradise Gardens signed a new contract with the person who made this complaint. The work was started, we spent six days at her house with 6 employees. These employees had been working for Fries Mill Landscape Garden Center at the time and decided to stay on with Paradise Gardens. Tracie even fed the workers almost every day. We had received Kudos from Tracie for the work they had completed. We totally completed the sprinkler system which was damaged by Fries Mill Landscape when they removed the grass from the rear yard. The edge stone was placed around the pool with river rock, the path ways and borders where also prepared and packed ready for EP Henry installation. All of the EP Henry pavers were delivered to the site. When we signed the contract with Ms.Tracies husband in our office we made a mistake and put down a substantial completion date of 7/4/2007. At the time Ms. Tracie's husband Michael said he didn't feel that 7/4 was a reasonable amount of time to be substantially complete. I suggested that we redo the contract and Ms. Tracie's husband Michael said that it wasn't necessary that they would work with us if there were any problems. In the beginning of July when I asked to have the completion date extended to July 29th it was refused. Our contract stated "The work to be performed under this contract shall be commenced on or before June 25, 2007, and be SUBSTANTIALLY completed on or before July 4, 2007. The following constitutes substantial commencement of work pursuant to this proposal and contract(weather dependent): As of July 4, 2007 a substantial portion of the job had been completed, and the materials had been delivered to the site. On July 6th Paradise Gardens received a Certified letter that all work at the property would cease and desist. And requested that all monies issued to Paradise Gardens, not Robert E Bailey Jr., be returned. I would further mention that all monies received were checks made out to the companies involved and deposited into a company checking accounts which it took two signatures on a check to withdraw any monies. I did not take or spend any of the money for personal use. I WAS A 1/3rd owner of Paradise Gardens, I was a not an owner of Fries Mill Landscape/Garden Center, LLC. I was not an owner of Earth Under Construction. These companies were owned by Joe Cirino and John Homan, and operated with no input from me. I am the owner of My Lawn Care Company which was not part of any of these accusations and did not exist at the time. I am not a EP Henry paver installer, that was the job of John Homan, hired and eventually made part owner of the business with that responsiblility. I am by nature a very respectful person and treat other people with the same respect given me. I would never be abusive to anyone. It is not good business practice to be argumentitive or abusive. The only abuse I know of was between Ms. Tracie and Mr. Homan, which I did not hear but was informed by both Mr. Homan and Tracie that it had occured. As I see it Michael and Tracie were the ones in breach of their contract as the work was substantially completed and the verbal agreement to overlook the July 4th substantial completion date was not honored by Ms. Tracie's husband. I do have other witnesses who will testify to the statement made by Ms. Tracies husband to extend the substantially completed date. I did not and will not hire illegal workers, at the time Fries Mill did have a contractors license and Paradise Gardens was operating under that license. As far as Joe Cirinos rebuttal it could not be further from the truth as to being thrown off the property. The judgement against me was a default judgement because the lawyer I hired to defend me did not answer the complaint within the proper time frame, and as such I had a default judgement entered against me. I believe that if I had the opportunity to defend the claim there would have been no judgement against me personally and Paradise Gardens may have been able to defend itself also.
