On 5/26/11 I chose to go to Tower Wireless (a different company than Verizon) who sells phones for Verizon. I purchase a brand new phone for $127.19.  The next day  I noticed that almost every time I looked to see if I had any messages, the phone would be "off".  I would have to push the power button to turn it back on and then all of my missed calls would appear.  Due to the holiday I did not return to the store until May 31, 2011.  I informed them of the problem and manager Eric Wright stated that the location did not have any more new phones of my style and he would get one from another store in the area and call me when it was in.  On June 8, 2011 I had not yet received a call and returned to the store in person to check on the phone.  Mr. Wright was not there but salesperson Maria Scroggins was there and knew of the problem.  She stated that there was still no phone for me.  She said she would contact Mr. Wright and get a phone in ASAP.  I informed her that I would be unavailable for a week or more and would come back in when I could.  She said a phone would be there for me.  On June 21, 2011 I returned to the store.  Mr. Wright stated that he had gotten a phone for me and I did not stop to get it in time, so he sold it to someone else.  He stated that he tried to call me and it went straight to voicemail (b/c the phone turns it's self off).  He said he didn't "feel" like leaving a message.  He then stated that he would have a phone sent to my home via FedEx.  When the phone arrived, it was a refurbished phone.  The same one I could have gotten for free and the same one specifically did not want.  I contacted Mr. Wright via phone and told him I would like to return the original (defective) phone (with all receipts, paper work, and rebate forms) and get my $127.19.  I would then find a replacement on my own not involving him or his store.  He stated that it was past the 14 day return policy and that I could not return the phone and he would not refund any money.  Essentially I am stuck.

Tower Wireless contacted me the same afternoon that I filed this complaint and refunded 100% of the money for the defective device.
