Otis is not, and never was, a consumer he was a ClickCash marketing affiliate, selling *to* consumers. We require our marketing affiliates to adhere to high standards of conduct, and we make those standards very clear. As stated previously, Otis engaged in unfair and deceptive marketing tactics that violated the ClickCash Terms and Conditions, and he failed to meet the standards that he agreed to uphold. We first provided Otis with the opportunity to rectify his misconduct, and he failed to do so. With clear evidence of his continuing misconduct, we appropriately chose to terminate his account. In his latest update, Otis says he received information from a website called clickcashforum.com this website is not operated or administered by our company. The only valid information on program standards is found at ClickCash.com. Otis' reliance on third-party information does not negate or excuse the critical fact that he participated in a scheme aimed at misleading consumers.

How can you cancel and don't pay me for signing up for an affiliate for someone else it was no scheme I was not misrepresenting at all. The people I signed up were interested in webcams thats why they signed up for the site and your own clickcash admin said it is ok to post in forums and talk to people to see if they like the program heres the link http://clickcashforum.com/index.php?topic=25.0 and you do lots of people like this every week. Pay me for my sign-ups these are people i dont even know and talked into signing up to try the website that is by no means violation of terms!!!!!!

With the information provided by Otis in his complaint, we located his ClickCash affiliate account. We track all referrals and signups extensively, and we were able to determine that he was introduced to the ClickCash program through message board advertising which violates our Terms and Conditions. The person who introduced Otis to ClickCash was engaged in improper pyramid scheme marketing, which is a violation of the ClickCash Terms and Conditions (http://www.clickcash.com/new/agreement.htm). Individuals were not signing up for the participating site's programs because they were truly interested in the program they signed up through the ad to generate commissions for the affiliate who had improperly placed the message board advertising. ClickCash's Terms and Conditions clearly state that misrepresentations of the program in any way are a violation of the Terms and Conditions, and can and will result in the immediate termination of the affiliate's account. It also states that if the affiliate crafts custom marketing messages, that these 'must accurately and truthfully represent the materials offered, and may not be false, deceptive, or misleading.' The ad through which Otis signed up violated ClickCash Terms and Conditions in these respects. When Otis created his ClickCash affiliate account, he advised us that he had read, understood, and agreed to the Terms and Conditions, including the section listed above. By participating in the pyramid marketing scheme described above, he violated the affiliate contractor agreement. Based on the Terms and Conditions violations, Otis' account was cancelled. While ClickCash is happy to pay out for legitimate customer traffic, Otis still has not provided us with examples of commissions that were legitimately generated by methods that did not violate the Terms and Conditions. Once we receive documentation from Otis validly establishing his strict compliance with the Terms and Conditions, we will be happy to pay him out for any sign-ups that were the result of marketing that did not violate the Terms and Conditions.

According to the correspondence we have from individuals who were referred by you, the marketing they describe that introduced them to the programs does appear to violate the T&C. Please note that, due to the nature of the violations, all future contact with ClickCash regarding your account must be via e-mail. -Stacy From: otis Sent: Wednesday, September 19, 2007 5:45 PM To: Stacy Subject: RE: Recent Call to ClickCash {cc:MONEYFRESH333} You have me mixed up with some one else mam they may have other people in the freelunchroom that are paying 15$ for a signup but not mine I gave you the link to my pages or it maybe someone in my downline or upline but this was my first week and I wasn't paying money and how can you say I didn't turn in my terms and conditions when you guys already sent me an e-mail that says you got it??? Your account has been updated to reflect receipt of this agreement. Any pending stats due on your account (based on the minimum payout you selected at sign-up) will be released at the end of the current pay period, according to the regular Clickcash Payout Schedule. Good Luck ! Clickcash Support Team [email protected] Also I did not misrepresent the company everyone I signed up knew it was an adult webcam site so you guys need to check my links they go to my escort site and I talked people into visiting my site and then they signed up. I told them after if they wanted to sell these same websites sign up under me. I did not violate at all. Asking people to chec Dear Mr. ---: Thank you for your recent call to ClickCash. I am sorry that I was away from my desk and unable to take your call when you attempted to reach me. In reviewing your account, it appears that it was terminated by our AUP department for being in violation of multiple aspects of the ClickCash T&C (clickcash.com/new/agreement.htm). It appears that your pages: * Offered users $15 for signing up for iFriends. As the T&C clearly states, you will not offer third parties consideration or incentive (for example, $15) for signing up for the iFriends service (Section 5 of the T&C) * Implied or Stated that iFriends was linked to Escorting or other means of meeting individuals for sexual experiences. As you know, iFriends chathosts are prohibited from meeting individuals in real life that they have met through iFriends. As such, your marketing was misleading and misrepresented the iFriends service (Section 7, part VII) * Lacked clear and concise notice that all models appearing on the pages were at least 18 years of age at the time that the images were taken (Section 7, part V) * Potentially exposed individuals of questionable age, or who were not interested in adult marketing to adult marketing via your usage of message boards/forum discussions (Section 7, part IV) As such, based on the above violations observed in your marketing, your account has been terminated. No new accounts, established by you or on your behalf, will be honored as valid with any ClickCash or WPI-enabled platform. Regarding your belief that there are commissions due to you, please note that the T&C states (as did the "Welcome" e-mail you received at sign-up) that payouts will be remitted only upon receipt of a signed and completed T&C. To date, we do not have a T&C on file for your account. Please note that ultimately you are responsible for the marketing that you engaged in with regards to the iFriends/ClickCash program. Our T&C is very clear as to what sort of marketing is and is not allowed. If someone advised you differently, you still advised us at sign-up that you had read and understood the T&C and would adhere to its policies. If you have any questions, or feel that your marketing did not, in fact, violate the T&C, please feel free to e-mail me with documentation that you have that would contrary to our AUP department's findings. Please note, however, that I will not respond to any e-mails that contain threats or foul language. I will only respond to e-mails that contain constructive dialogue. Sincerely, Ms. Stacy Michelle Director, ClickCash Support [email protected]
