In March I contacted, Michael Hughes, and hired him to install a Navien tankless water heater on my property. We came into a signed business agreement detailing the specifics of what would be installed in the contract. Via text we discussed that he would

(1) email me paid receipts as items were purchased,

(2) pull permits for the tankless water heater installation and email me a copy of the permit, as well as

(3) set up a payment plan which detailed he would need $1,450 for the initial deposit to purchase Navien along with supplies and final payment of $1,450 on Friday, March 20, 2020 on the date of completion of the job.

The following unfair or deceptive acts occurred:

On March 9, 2020 I paid a deposit via Venmo to @Michael-Hughes-296 for the amount of $1,450 to purchase a Navien tankless water heater, and materials for the tankless water heater installation after discussing a quote and writing up a contract on March 7, 2020. On Friday, March 20, 2020 I paid an additional payment in cash for $725 for Mr. Hughes to return the following day to complete the installation of the water heater. The payments I made of $2,175 for the installation total more than 1/3 of the legally allowed deposit in Massachusetts for unfinished work.

On Friday, March 20, 2020 Mr. Hughes performed work on my home that required a license and used an unlicensed and/or unregistered subcontractor. Mr. Hughes began work without a building permit when one was required. On March 24, 2020 I confirmed with the town  building department that a permit was not pulled as of that date.

Mr. Hughes did not provide current Certificate of Registration, or proof of a plumbers/HVAC license upon multiple requests in-person, via text, and voicemail. When I searched Michael Hughes (and the multiple business names he used for work including but not limited to M.H. Mechanical, Inc., Third Generation Heating and Plumbing, Edward Hughes and Sons Inc., Shamrok, Wicked Fast plumbing) on the licensing.mass.gov website Mr. Hughes or the business names did not appear.

Mr. Hughes did not complete the work within the 1-2 day timeframe originally agreed upon verbally after the deposit was given. He continually provided an excuse as to why he was late, and was unreachable via phone, and text. He was difficult to contact on the day of the job and was not responsive to my calls or text messages. He would message me that he would be on his way and not show up the day of.  My husband, Harold Matos, took a day off work on March 24, 2020 to be home when Michael said he was on his way. He would contact me on different phone numbers including (857) 237-9806, (857) 770-2677, and (857) 294-9635.

Mr. Hughes failed to include in the contract realistic start and completion dates. He made a verbal agreement on March 7, 2020 that the project would take 1-2 days to complete. He began work on March 20, 2020 and has not returned to my home to complete the work as of 3/25/2020. He has failed to reply in a timely manner after multiple text messages, and calls from myself, and my husband, Harold Matos. The refund/return policy was not clearly posted where it can be readily noticed and understood on the contract.

Mr. Hughes performed work in a sloppy and defective manner. He left his work unfinished. The window that was removed in the basement to place the tankless water heater vent was left uncovered with two circular holes to place the vent allowing access to the basement from outside of my property. The plywood was cement sealed in a sloppy manner.

This unfair or deceptive act or practice is, in my opinion, declared unlawful by Section 2 of Chapter 93A, which reads as follows:

Section 2. (a) Unfair methods of competition and unfair or deceptive acts or practices in the conduct of any trade or commerce are hereby declared unlawful.

(b) It is the intent of the legislature that in construing paragraph (a) of this section in actions brought under sections four, nine and eleven, the courts will be guided by the interpretations given by the Federal Trade Commission and the Federal Courts to section 5(a)(1) of the Federal Trade Commission Act (15 U.S.C. 45(a)(1)), as from time to time amended.

(c) The attorney general may make rules and regulations interpreting the provisions of subsection 2(a) of this chapter. Such rules and regulations shall not be inconsistent with the rules, regulations and decisions of the Federal Trade Commission and the Federal Courts interpreting the provisions of 15 U.S.C. 45(a)(1) (The Federal Trade Commission Act), as from time to time amended.

He has worked under the name Keith Gass and has hus girlfriend Kerri help him scam people. He also has another person work with him. File a criminal report, 93A, and contact the district attorneys office to speak with a victims advocate and be placed on that list.
